By what I have been reading here, the two of you have only tried to meet once and unfortunately the plan was not successful. That's not much of an effort.

I doubt your doctor says you can't fly forever. I've had heart problems and DVT for years. I've flown from the South Carolina to Ukraine several times this year. It's not an easy trip for me having to take 3 planes and approximately 20+ hours door to door but I do it and continue doing it. People who had heart surgery can fly in 2-3 weeks. Many people have DVT and still continue to fly. Typically when a doctor says you shouldn't fly, it does not mean forever. Perhaps you should try to get a second opinion from a different doctor. If your condition is so bad that you can't fly, get medical treatment to improve your condition. You can also spend the extra bucks to fly first class which is much easier on you. There are lots of things you can do to make your health better so that you can get on a plane.

He didnt deny it bc he wants to make sure you did not in fact visit each other in the 2 years. honestly, that isnt normal! and you need to visit in the 2 years. however, after you have no proof of meeting and clear up that 'i booked a plane ticket to CR but never actually went there' he will outright deny your petition. Wow, I'm glad you're not my USCIS officer..lol

you hired a K1 firm they filled an application out! they are NOT A SKILLED WAIVER LAWYER! good names of good waiver lawyers. call one who has delt with this! any company can file a K1. I can file a K1! its not difficult! Search on this forum and see if people who could not fly and petitioned for their fiances got a visa. if they did, then research how they got it. if they didnt, then you probably know your answer. like someone else said, fly her to mexico and drive down. or just date in america. i really dont think USCIS is going to approve this petition and i think all the $$ and hasel you will go through is very easily solveable. Can you please tell me how I would be able to fly her to Mexico or date her here in the U.S.A, when she wasn't allowed to board a plane to Costa Rica?

Not sure what doctor you go to, but if a "qualified" doctor tells me that I am taking a risk of possible death by flying, I am sure not going to take that chance and fly! Also your medical conditions are not the same as mine!

Hello Everyone! I met a girl that back in October of 2015. We started communicated by phone, emails, and Skype, and both fell in love with each other over time. I decided to hired a visa service company to do my K-1 petition for a fee. The company I hired told me that is was very important that me and my fiancée meet. So in April of this year I arranged our flights and hotel stay in Costa Rica. I did tons of research before booking the flights and the hotel. She lives in the Philippines so I had to book a flight that would bypass the USA as to make matters more simple. Anyways, long story short, she was stopped by the Philippine Immigrations and was handed a white piece of paper stating that she needed more documents and was denied entry onboard the plane. We both thought that we had all the documents needed for her to board this flight. I believe that the Philippine Immigrations make it nearly impossible to leave the country! I then called and tried to cancel both flights :( I was really depressed and started getting chest pains and anxiety, so I called my doctor and he told me to come to his office. I then told him what was going on and that I planned on flying to Costa Rica to meet my fiancée. He then told me that because of my medical conditions it was a good thing I never boarded the plane as I have heart conditions and DVT along with chronic anxiety and depression. With these conditions he said could have been fatal. I had no idea about this until he explained it to me that day. Ok, now I told all this to the company that is doing my K-1 petition, and they told me to get my doctor to write a letter about my medical conditions regarding flying. So I did everything I was told to do and sent in the K-1 petition in to USCIS. I have been waiting now for over 2-1/2 months and I just received an RFE letter from Department of Homeland Security/USCIC for my K-1 petition. It came with 1-blue page along with 2-other white pages numbered 2 and 3. On page 2 is the Request For Evidence that says REQUIREMENT THAT PETITIONER AND BENEFICIARY HAVE MET IN PERSON and Last Personal Meeting. I'm not exactly sure why they sent this page as I was trying to get the meeting waiver approved, due to my medical condition! Now on to page 3, this is where they made an error. They are saying under the Waivers of the 2-year Personal Meeting Requirement That I submitted a correspondence from my physician that recommends without reservation that I abstain from flying. However, Service records indicate you have recently flew to Costa Rica. Moreover, your request for a waiver of the meeting requirement does not include any evidence of the petitioner and/or the beneficiary attempting to utilize other methods of travel for either individual to fulfill the requirement. The evidence submitted is insufficient to establish a favorable decision to granting the requested waiver. This is incorrect as I never flew to Costa Rica. I do have proof showing my cancellation from American Airlines as well as my passport that was never stamped. Can anyone please let me know what I should do at this point. I would be deeply grateful and much appreciation! Thank you for your time reading this mess!

Im sorry to hear about your health,perhaps what they meant when they said that you recently flew to costa rica was not the day that you were supposed to meet your fiancee.Have you flown there before that day?

Maybe you can write a letter explaining the whole thing,print the cancelled plane ticket

They maybe saying you didnt try to meet bcoz after that,she didnt attempt to meet you,like apply for a tourist visa.

Or like what others suggested ,get a lawyer that specializes on this kind of case..good luck to you.hope everything goes well

Thank you very much for your kind words! I have never flown to Costa Rica or anywhere for that matter! I was looking forward to doing this, as I love my fiancée and wanted this to be a very special occasion for her. It was also the week of her Birthday :( The USCIS has no idea yet of what really happened. I guess the officer that is doing my case ran background checks and came across the ticket I had purchased and assumed I had flown there! It wasn't until after we both made an attempt to meet as to fulfill the meeting requirement, that my doctor told me that because of my medical conditions, he advised me to abstain from flying. I did turn a letter in with my petition with my doctor stating this. I really believe what happen was that this USCIS officer received my petition and read the letter from my doctor, then saw that I did book a flight to Costa Rica and assumed that I flew there. I am guessing that this officer saw a conflict of interest here, and decided to send me an RFE! It is most definitely an error on their side! I am going to try and find an attorney this coming week and hopefully I can get this resolved for the best. I could take a gamble and just write a response letter along with the documents to prove all this, but I guess I have come this far, why not spend a few more dollars and talk to a qualified attorney that has specialized in situations like mine. Can anyone here tell me a really good attorney with a high success rate for getting these meeting requirement waivers approved?

I have been on these boards for many years and can not recall one approved waiver for meeting in person.

If there has been one I can not think of one and that is why you won't find any suggestions for a specific lawyer from members here, we simply

do not see these situations to point you to one.

You can use google and find lawyers writing on their web sites about it such as this one :

There are many others and you can call each one and ask them how many they successfully waived.

You will likely just spend money without the result you seek.

You also have to keep in mind that even if USCIS approves the waiver you still have to go through the hardest part which is the embassy

and who would very likely deny the visa at their discretion.

You should place your focus on finding a way for your fiance to travel to a third country.

It is really not a good idea to bring someone here you have never met face to face as most do not ride into the sunset

happily ever after and all hell breaks lose. USCIS knows this. The embassies know this. We read many threads of the USC

being used by immigrants and once they are here their true colors show and that is with couples who have been together face to face

several times.

International dating, the immigration journey and the integration of beneficiary once here is extremely stressful and I do not

advise it to just anyone who is trying to avoid stress for medical reasons.

You don't think there will not be any but let me assure you that if you proceed you will soon experience it.

I wish you the best and realize that people have to find out things for themselves and do not believe bad news apply to them.

If you plow ahead at least try the third country possibility, how I don't know but that is for you to search out.

We do not have the answers here you seek to hear. I am sorry for your situation but am trying to stay real here.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
