Timeline

I'm an American living in Norway with my Norwegian fiance. We've been here for two years. We were going to get married here and file I-130 in Norway. Then... they stopped accepting these petitions. We went ahead and filed for a fiance visa in the U.S.

Now they are accepting petitions again.

We would much rather get married here and file in Norway than go through the fiance visa waiting game. What should we do? Can we cancel our I-129F that is being processes?

Advice needed!!

02.08.07-mailed I-129F

02.13.07-I-129F received in TX

02.20.07-NOA1 mailed from Cali

02.27.07- NOA1 received snail mail

04.11.07- married in Norway & withdrew fiance petition

04.12.06- DCF in Norway, mailed I-130 to Embassy

04.13.07-Interview scheduled for 05.02.07!!!!

05.02.07- VISA APPROVED

This would probably get a better answer in the K1 forum as there may be people there who have dealt with retracting an I-129f.

US Immigration Timeline

-------------------------

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

FIle the I-130 at the Embassy in Norway...

Write a letter to the Service Center that you sent the application at and withdraw the peitition... you'll be out the money from the I-129F

I think that is what we are going to do. I spoke with the Embassy in Norway. It used to take a week start to finish here but now they are expecting things to be slowed down a bit since the Adam Walsh check.

Nothing like being the first to try out a new process. Cross your fingers for us! I would have to cancel our other petition and spend all the time getting paperwork ready for the I-130 and have it take the same amount of time or longer than the fiance visa!

I will keep everyone posted on our progress.

We will really appreciate any procedural info you can share, since this is new-ish to all of us now.

btw, even if the immigrant visa takes as long as a fiance visa (which it won't, buuut), the benefits of arriving with an IV over a K are huge. And you save quite a bit of money and time for completing and becoming a PR.
