Quickest Way To Immigrate...

Hi All,

So, in a nutshell, this is our situation. My girlfriend and I are trying to figure out the quickest way possible to get me to the US to be together permanently (and be able to work, of course). Having read through numerous threads, we are still unsure as to what is our quickest route, so here is the scenario:

1. I am a UK citizen living in the UK (I have never lived in the US)

2. She is a US citizen living in the US (she has never lived in the UK)

3. I have no 'in demand' skills professionally (i.e. I am struggling to find a company who will Visa sponsor me)

4. We want to get engaged / married regardless

Our question is, what is the quickest possible solution to our problem? Getting engaged and applying for Fiance Visa? Or getting married either in the US or UK then applying for Spouse Visa? and if marriage is the quicker option, which country should we marry in (i.e. who will process the Visa quickest)?

Hi, the absolute quickest way is K1 Visa,.. however you're not able to work until you have your GC processing finalized. The CR-1 visa does take longer (our "journey" has taken 10 months so far, interview after 11 months) , however it is cheaper, and you can start working right away when entering the US.It does not matter in what country you marry,..the time frame is the same as long as you have all the legal documents in order.

Regardless of what route you choose, it is time consuming and frustrating... it is the same for all of us. All we want is to be with the one we love..right.

You can work before your GC is received using your EAD ( work authorization ) which takes like 2-3 months to arrive after you file for it :)

Fiance visa (K1) is the quickest path to being together, spouse visa (CR1) can be the quickest way to a green card. Luckily, you can get work authorization before the green card comes in, though some employers may see it as a "risk" to hire you (because work authorizations are temporary). That's a bit of a risk, but not a huge one.

It basically boils down to where and when are you going to wait for your green card. CR1s come with a green card automatically-- so they immigrate and get a green card all at once, K1s need to immigrate, marry, apply. The time difference between CR1s and K1s is basically the green card. So, you want to wait for it abroad, separate, or in the US, together? There's no right or wrong answer, everyone's situations are unique.

Keep in mind, too, that to apply for the CR1, first one or both of you must travel, you get married, you get the marriage certificate and *then* you can apply. I understand that your girlfriend would need a visa to come to the UK to get married, but I am unclear on that--sounds like a pain in the neck to me, so do it in the US or a third country.

K1 you could apply for tomorrow as long as you've seen each other once in the last 2 years. You just need to sign a letter stating that you intend to get married within 90 days of your arrival in the US. I have read that scanned copies of that letter have become acceptable (don't quote me on that, find someone who applied in the past 6 months). But just like the marriage part of CR1 can delay the ability to apply for the visa, the marriage part of K1 can delay the ability to apply for the green card and work authorization. Even if you get married the day you land and have all the paperwork set and ready to go (literally no one does and it would be insanely difficult), you still need to wait for your marriage certificate which can take a few weeks, depending on the jurisdiction.

So there's no right answer here. But the choice really is "together quicker, or working quicker", which is a terrible position to be in but.... welcome to the club :/

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:
