Hi guys!

I had a question about the I-134 Support form, I've looked around and can't find an answer so I'm hoping someone can help me.

Here's the background;

My fiance lived with his sister and her family last year to help contribute to the household, his sister is on disability so he was helping quite a bit and he claimed her and her child on his taxes. So his 2015 tax transcript shows 2 dependents.

However, this year he is no longer living with them so he will not be claiming them as his dependents. So my question is this, does he have to list them as dependents on the I-134 form as they are on his last years tax transcript? Even though he will not have them on there for this year?

If yes, then would he list them as wholly dependent or partially dependent?

Thanks in advance!!

He would list them as a dependent until he does his taxes again.

Well hopefully that will work... does he make over the 125% for the number of dependents he actually has? Because you only have 90 days to get married. Then you have to AOS so unless you plan on doing that after he files taxes, the dependents will still be there for the I-864 as well.

Yes, he makes over the 125% for his dependents and me included.

I don't plan on entering the US immediately as I have some work commitments, I'm planning to enter the US in January and we are planning to get married in February and we'll be filing the AOS after he does his taxes.

Ah Okay that'll work for you then but at least he's covered financially.
