Hi,

I am married to a US citizen, and I filled for I-131, I-485 and I-765 concurrently. My interview is scheduled on 20 Oct 2016 but the problem is my OPT expires on the same day. At present I am employed and I want don't want to lose my job. Is there a way out ?. Has anyone received I-765 approval beforeI-131 approval?. Can I keep working?

Any guidance or help would be greatly appreciated.

I-131 is the travel document so I assume you mean I-130 (which is the petition for a spouse). The whole point of the EAD is that is approved before the whole AOS; once you have your greencard you no longer need the EAD. When did you file?

Applied : July 22nd.

Biometric appointment: August 23rd

Interview Scheduled: Oct 20th

However, my OPT extension expires on 20th Oct too. Also, I am getting an error message when I check the status of my I-765 application.

The EAD takes 90 days so it'll be the same time as OPT expires. You should try to expedite the EAD based on loss of job.

Expediting the EAD is one way out, or you're risking eligibility to work after OPT expires if not approved at the interview for whatever reason.

I called the USCIS today and they told me to wait for 75 days before I can submit my expedite request. Is it true?. Just to clarify I am on OPT extension which is expiring on Oct 20th this year.

No it is NOT true.

Thanks for guiding me. I was able to put an expedite request for my EAD card. I was told that I will know the decision by next Monday about the result. The tier 2 officer was nice and he put the case under high priority.
