DCF in Canada now?

duh...we thought we knew where to file, but now we're dazed and confused again!

My USC husband and I both live in Canada. So are they taking DCF's in Canada (Vancouver?) now? Would my hubby have to go there in person? (he can't) We were about to send in the petition for the I-130/129F (CR-1/K3) to Vermont.

I-130 Timeline

2007 May 04...... I-130 packet mailed to Vermont

2007 May 11.......I-130 packet received by Vermont

2007 June 05......NOA1 generated by VSC

2007 June 06......Check cashed by VSC!

2007 June 08......Touched

2007 June 10......Touched (on a Sunday? Whaaa?)

2007 June 12......NOA1 received !!!

2007 June 22......Petition Approved !!! NOA2 received (by email) Paper NOA2 mailed out

2007 June 24......Touched (again on a Sunday!)

2007 June 26......Case arrived at NVC. Case number assigned. Told to expect snailmail notice in 6-8 weeks

2007 July 06.......Paper NOA2 received in snail-mail from Vermont

2007 July 09.......NVC generated DS-3032 and AOS fee bill

2007 July 11.......Emailed Choice of Agent letter. Received auto-confirmation of email receipt from NVC

Sorry.. it appears that DCF is no longer available in Canada (like it used to be), they have mentioned nothing of reinstating DCF on their website... It looks like you're going to have to send your stuff to Vermont... However, you may want to contact the consulate's American Citizen Services Unit to make sure... and yes, the I-130 has to be filed in person...

Although I'm less confident than my pal zyggy on the current state of filing I-130 in Canada, that type of filing will always require an in-person appearance. If your USC spouse won't go to a Consulate, you really only have one answer: file to the US.

DCF is available in all consular posts again by order of the Department of State since March 21st. You can present your I-130 IN PERSON in any Consulate in Canada (check www.amcits.com for information on hours and stuff). Now, If you are applying for a K-1 or K-3 visa, you can petition to be interviewed in Vancouver. If it's a CR-1 visa (immigrant visa) you will have to go to Montreal as they are the only ones who handle immigrant visas in Canada.

We have the same problem here in Europe. We went to the American Consulate in Amsterdam with our I-130s just to be told that we were not able to file there anymore due the decison of the State Department not to accept these anymore, and that we should file in Frankfurt.

When I called Frankfurt, they said that Amsterdam would have to accept our filing. Amsterdam said, no they could not accept it and we should file by post in Amsterdam attaching the USCIS ammouncement of February 27, 2007.

I guess we could do that, but seeing that Franfurt services next to Germany and the Netherlands also Switzerland, Luxembourg and Belgium, we're afraid that it won't be 3-4 months but a year if we file there. So we're wondering if it might be shorter to just wait and hope for the decision to be revised - as they said it might be.

DCF is available in all consular posts again by order of the Department of State since March 21st. I think there might be a problem with Canada though . . .Yeah all of the other consulates are accepting visa app's because they have their own overseas USCIS with which they can use for the background checks. However Canada has to rely on the USCIS's in America. The overseas Embassies have no problem with their respective USCIS because there is basically little to no backup in them like there is in America so my guess is that the consulates are saying screw it because it will take us just as long to get a background check as it would for the petitioners to fille themselves in America so they are making them file in America . . .

European . . . you can now file in Amsterdam the consulates have been open for about week now. Check it out give them a call.

The Department of State was clear in their instructions of March 21st. ALL Consular posts should immediately resume receiving applications and I find it hard to believe the Consulates would disregard an order from their boss (although I disregard my boss all the time, but that's another story LOL) for I-130 petitions. As per I-129's and other I have no idea. I called MTL and they told me my case was going ahead - so Canada is up and running! Then again, we were in the middle of the process already, so it may be a slight different for NEW petitions; with the new rules now in place.

That's correct... the consulates would have to forward any petitions to VSC for the check, so it's just more economical for the peitioner to just file it there in the first place.

From the short turnarounds promised from some of the Consulates now, I don't think it's the same as sending the petition to wait in line with everyone else in VSC. I think the Consulate accepts it, and they have an in-house or shorter turnover process to get the newly required check done, and fwd to MTL when completed.

We won't know for a bit, but I think filing in Canada would still be faster than sending straight to Vermont, as of now.

That's the thing.. none of the consulates have announced that they're taking them... they're telling people to send it to VSC right now... if it hasn't changed yet like everyone already has, they may not change at all..
