Ok well I am sort of at a loss here. My question is this. If my elderly moms green card is pending for years as some people have indicated, due to the FBI name check after the interview, and has a heart attack or gets sick with cancer or something and the application is "pending" am I still responsible for any hospital bills? This state has "medi-cal" . which means I cant purchase private insurance if she is under a certain income bracket. I WANT to purchase insurance.Without a green card I cannot get medi-cal for her. This whole thing is crazy. We are in a uscis black hole.

Is your mother in the USA?

It is possible to get her insurance but it will require so searching and you may have to pay premium prices. Without any kind of status your mother likely doesn't qualify for government assisted healthcare.

It's not going to take years. She would probably qualify for emergency medicaid if something like that happened which is not a means-tested-benefit.

I don't know, what is happening with your case? Last I heard you were just waiting for new fingerprints. Are you sure she is being held for namechecks? That most usual for people from countries with terrorism and common names. I mean, I guess Russia has Dagestan, is she from there?

I don't know, what is happening with your case? Last I heard you were just waiting for new fingerprints. Are you sure she is being held for namechecks? That most usual for people from countries with terrorism and common names. I mean, I guess Russia has Dagestan, is she from there?

Hi Harpa, So at the interview we were told by the IO "you should here from us in about a week on the fingerprints" that was 3 weeks ago. So I called uscis and the tier 2 person I talked to said " they are doing an FBI check because her fingerprints were bad" I have no idea what that means and she couldn't really explain it.She kept trying to get me off the phone.I thought they would send us for new bio metrics, but I guess not?My mother in law is from near Moscow, her name is NOT a common name. In fact she has never met any one with her first name, because its an old name that is from a very tiny village.

ANY info on this process would be helpful

Name checks are not uncommon and most are quick. Given your mother in law's background, it should return no hits and USCIS would be notified promptly. Unless, that is, your relative does have an interesting history y'all don't know about, which is not likely.

In terms of healthcare, if you're applying for Obamacare, note that you will have a thirty day wait after the application is fully processed and even then, you'll have to submit proof of their income, tax filings, etc. The process will take months. We have sponsored my in-laws and I'm very familiar with this process. It's neither smooth nor quick.

In the meantime, it's not unwise to buy some private urgent care insurance. In addition, county hospitals are not allowed to turn anyone away by law so if disaster hits, God forbid, know where your nearest county hospital is.

Finally, and this is a generally good practice, encourage your in-laws to eat lots of fruits and vegetables and go for long daily walks. Not only is it good for their physical health but also mentally. The biggest issues we're facing with elderly immigrants are loneliness and boredom from sitting in an empty house all day. Those tend to be bigger concerns than sudden health crises.

A normal namecheck takes about one minute. The issue is getting someone to do it (it sits in a pile for a while). If the person fails that, then their case sits in more piles and the delay is longer. But I expect your MIL would pas the first one.

If the IO said one week, wait as lnog as you think is appropriate, then make INFOPASS and inquire, in case the case was forgotten.

And you are not on the hook for the I-864 until I-485 is approved.

I am a bit lost... How long has she being waiting??

You said "years" in the first post and I am seeing a " 3 weeks ago".

On the Facebook group, others have reported that they waited for 120 days or more for their GC.

And it looks like they are a bit slow at the moment.

I cant apply for Ocare in my state. Medi-cal is mandated for people who are at certain income levels.

No, some one said this FBI name check can take years,I was commenting on that.Thanks for the info on The FB posts, I had no idea that even existed.

Harpa you are so so helpful. Thank you for shedding light on this, its refreshing that someone has info on this.I had no idea that's how all this works. The tier 2 lady I talked to on the phone made it sound like the FBI goes through some sore of paper files if they dont have fingerprints and that was super confusing.

But this story still isn't making sense to me. If they don't have fingerprints then they ask for a new biometrics to get the fingerprints. Sometimes people's fingers aren't oily enough and they don't get a good read. It seemed from your story that that was the issue. I figured you'd be waiting for a biometrics appointment. Are you sure you talked to Tier 2 about namechecks?
