The VAWA Application was based on abuse and I have good evidence. She stabbed me with a knife, threatened me with deportation and she bring guys who have guns to the house. My life was at stake so I had to run and stayed in a shelter for awhile. From there I filled for VAWA but it was denied.

it seems unlikely that Vawa was denied, yet nothing else happened and you were just allowed to overstay for so long, if they had the right address etc to send deportation notices to you.

At the very least, you will face very strict questioning at your next AOS and they will look at your current relationship closely. I do think you may want to get a lawyer involved here...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

So you submitted police reports for the stabbing and the gun threats and got a restraining order against your ex-wife?

When were you divorced? When did the new relationship start? All this is relevant to your case. See a lawyer quickly.

Also when you say up been "low key" does that mean you haven't worked all this longest time?

If you been working how with no SS#? Or are you using someone else?

Yes I submitted police report and pictures. Not been working and I was staying with a very good friend. Penguin_ie thanks for your advice. I think I should consult a good lawyer.

Your friend supported you all these years and you haven't earned a single dollar since entering on a B visa 7 years ago? AOS will be scrutinized in detail, but there's a chance with corroborating evidence of abuse.

Get an experienced lawyer. Soon!

that statement is a fallacy , only US citizens have the right to stay in the US. Justices doesnt mean it has to be fair, If this person has an order of deportation he has 0 chances to remain in the country even if he is married to a US citizen.

Deportation orders can be appealed. One of the specifically mentioned criteria for doing so is extreme battery or cruelty. So no not 0 chance.
