I-130 and K-3 happen at same time

Timeline

Hello friends. I have applied for both the I-130 and the K-3 for my husband. Now i am sorta confused as what is gonna happen next. Looking at the timelines on this website- it appears that many times both the I-130 and k-3 happen very close to each other. I mean what happens then? how does one choose which route to go? I mean could one obtain the K-3 visa and then wait in the country to see if I-130 happens fast, and get that visa as well. I would hate to do all that adjustment of status stuff........if K-3 does not allow my husband to come here a good 2-3 months early. please do explain. thanks.

I-130 is not a visa. K-3 is not a petition.

I understand you filed two petitions recently. Those petitions can result in CR1, IR1 or K3 visas. If the petitions are approved, your husband can eventually apply for those visas.

I-129F petition for K3 visa, will continue completely through the visa process with minimal further input from you unless they ask you for something that is missing. You'll provide some addition documentation to your husband in preparation for his interview.

The I-130, once approved, will just sit and do nothing unless you file an I-824, pay another $200 and ask them to keep in moving. You will then interact several times with the National Visa Center before the file is forwarded to the Country where you husband would interview.

If the I-130/CR1 file arrives on station before the K3 interview takes place, the interview can result in a CR1 visa. If you don't keep the I-130 moving, your husband will need to adjust status after arrival. There doesn't seem to be any data/experience yet regarding how long the I-824 process delays the I-130 progress through the system, so it's anybody's guess whether its a good idea.
