Hello there! Quick question.

My fiancé and I are not yet married but have prepared all of our paperwork (I-130, I-485...etc), we are planning to get hitched on 10/3 and wanted to know if it was a bad idea to mail out our forms on 10/4....My finance heard from a friend that it was a bad idea, and looked suspicious with USCIS.

Any thoughts?

How soon after marriage did you file?

Is there a such thing as too soon?

To be honest, I'm not sure! I think it honestly depends on other factors in the application, such as how long you guys have been dating, your current status in the U.S., and what kinds of evidence you guys have available. I think all of these things can affect how the immigration officer looks at your application.

For example, if you guys have known each other for three months, are getting married on 10/3, and you're on a Visa that expires on or around 10/4, the immigration officer might see this as a red flag because you haven't known each other for very long, and the marriage seems convenient based on your expiring visa.

If, however, you two have been dating for three years and have been engaged for seven months, that probably means that you have a lot of text messages together, you have photos, maybe you've gone on trips and met each other's family, then that might be a little different. I would suggest that you include any joint accounts you have because it all helps.

The one thing that might throw me off as an Immigration Officer is that people generally want to enjoy the days after their wedding, as opposed to stressing about sending immigration forms out. This however, can be easily explained in the sense that its one of those situations where you want to send things out fast.

If I were you, I would give it at least a week or two, but I can't really tell you for sure whether sending these forms out the day of the wedding is a bad thing or not. Its all subjective :)

His Visa expired back in June....we have tons of pics, texts, video chats while I was away and trips taken while we have been dating. Made the joint account last week.

Regarding the immigration officer scenario...I have to work the day after my wedding so we're planning the getaway on the weekend instead.

His Visa expired back in June....we have tons of pics, texts, video chats while I was away and trips taken while we have been dating. Made the joint account last week.

Regarding the immigration officer scenario...I have to work the day after my wedding so we're planning the getaway on the weekend instead.

Yeah, I would definitely wait a little because that honestly might seem a bit fishy. Do you guys live together and have any sort of lease? That would definitely help. As for the joint account, I know that submission requests vary. Some people are asks for twelve months worth of bank statements, while others are asked for only one month of statements. When I submitted my AOS, I submitted the most recent bank statement, as well as letters from the bank.

To be honest, given the new info you've provided, it sort of seems like you guys are rushing it way too much. I think that you definitely need to sit down and gather as many documents as you possibly can that can help prove that your marriage is in good faith and that you have a true relationship. Trust me, I know it sucks to have to wait extra time to gather information and whatnot. I got married in November and we didn't file until late March of the next year because we moved to a new city and had to open new bank accounts because are previous bank didn't have any branches nearby. We waited a few months to gather evidence. It was awful because of the work authorization situation, but honestly, I think it was the smart option. While you may feel like you're wasting time by not submitting the AOS documents, its better to take a little extra time to submit a well-made application packet, than to send something incomplete and to get an RFE (Request for Evidence) because the information you submitted won't enough. Requests for evidence definitely slow down the whole AOS process, so be smart about what steps you carry from this point forward.
