If your priority date is current you CAN file to adjust status. But it costs $1070 plus a medical ($200ish). With the cost of flights probably ends up a wash, but going to your interview makes you a permanent resident much sooner. Good luck.

Yes he can, if is Priority date is current. Adjusting is not only for spouses of USCs. It's all in the instructions.

Ah, well I just reread the instructions, and him being admitted on the VWP does preclude him from adjusting. But his wife being a LPR is not a bar. Had he entered on a B he'd be good to go. But he has realized following through with the original plan is better for him anyway.

I suggest everyone read the I-485 instructions; you'll like it!

I have my interview pending in London next month but my wife has just had an operation and my daughter needs to see a back specialist in Cleveland. I have been in usa visiting my wife and daughter so is there anyway for me not to have to return to the uk as i cant stand the thought of being away from them plus the cost of flights?
