Me too ?

 

I've been told to carry my expired GC and the original extension letter from USCIS (and of course my passport and second license) for travel. Does anybody have any other advice for traveling while in limbo with this? I'm a little uncomfortable with it too. Thanks ?

I used the expired green card and extension letter to travel to UK in Dec with my hubby. It worked fine but need to have lots of explanation with the airline because not everyone know what the extension letter means. However, I went with my hubby. So, I have no idea if people will get detain by themselves, especially after the Executive Order...

I'm traveling with my husband and  4 other US citizens for a group vacation. We are going to Jamaica and Mexico, so I'm a little worried that they won't understand the letter. 

 

We live in AZ and there are many Border Patrol Checkpoints, and several times when visiting on the 'Visa Waiver' I was asked to produce a Visa... And when I said 'I don't need a visa, I'm traveling on the Visa Waiver, the agents would look immediately concerned, and didn't understand that I didn't need a visa! While I never had any major issues, it was obvious that they weren't familiar with that side of immigration.

 

A valid GC is very common and easy to identify... But I don't know how often they see these extension letters, and it's got me a little worried... Especially with the executive order, as you say... ?

My wife and I traveled to Peru in December 2016 and she carried her GC with extension letter.  We didn't have any issues returning into the country.  Tomorrow morning (3/3) she'll be returning from Peru by herself, also carrying GC and EL, under the new administration.  I'll post an update how that goes.

My wife and I visited Taiwan for a month recently, and returned using her expired green card and the letter (and passport of course). Immigration agents at San Francisco airport instantly recognized the letter and knew what was going on. No trouble at all. I don't remember the airline even asking - if they did, they didn't give her any trouble.

Removal of Conditions:

2016-09-27: I-751 removal of conditions petition sent (with fee waiver request)

2016-09-30: I-751 petition delivered to California Service Center

2016-11-01: Informed in USCIS customer service call that they had no record of receiving our petition, but that it might still be languishing somewhere in fee waiver limbo

2016-11-01: Filed I-751 again, this time with payment check instead of fee waiver request (sent Priority Express)

2016-11-03: Date on I-797 Notice of Action (received 11/7)

2016-11-09: USCIS mailed out denial of our original fee waiver request, with denial letter dated 2016-11-02

2016-11-19: Biometrics appointment notice issued, for 2016-12-07 appointment

2016-11-26: Second biometrics appointment notice issue, for 2016-12-16 appointment (see this thread)

2016-12-07: Biometrics appointment. Allowed to complete biometrics despite mix-up on their end (again see this thread), but some people had to come back for second appointment date.

2018-05-01: Notice that our case was transferred to National Benefits Center in Lee's Summit, MO

2018-06-11: Approved after N-400 interview in Portland, OR (they seemed to be waiting for that before bothering with it)

 

Citizenship:

2017-12-11: N-400 Application for Naturalization submitted online while still waiting to hear back on I-751, received same day

2017-12-15: Biometrics notice

2018-01-04: Biometrics completed, on appointment date (Portland, OR)

2018-02-28: Interview scheduled for April 12 in Portland, OR

2018-03-01 (approximate): We sent in a letter requesting that the interview be rescheduled to after June 8, due to combination of work and family travel plans

2018-03-07: Notice that our April 12 interviewed had been "canceled" (pending rescheduling, but the letter didn't actually say that; officer at InfoPass later explained that interviews aren't scheduled until five or six weeks before the interview date, so they were waiting until closer to our requested rescheduling window)

2018-05-03: New interview scheduled for June 11.

2018-06-11: Citizenship interview - approved!

I'm gonna wait it out until 5 years. I'm getting annoyed having to keep proving I'm not using my husband for a Green Card. After ROC, I just want to either do an I-90 every 10 years or apply for citizenship based on residency length only. No more nosing into my life. That's just my personal beef, I'm not saying it's a bad idea to go for the marriage-based citizenship after 3 years.

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Hey folks, I have a question. I took the GRE test recently. There was a question on the waiver/consent form: "Are you taking this exam in the country of your citizenship?" Of course I checked the 'No' box.

 

Well, the test proctors asked me to show proof of legal immigration status before they would let me take the test. I showed the expired green card and they said that won't do. It's a good thing I had my extension letter but I had to explain its validity and how it extended my resident status till September 2017.

 

I had to control myself because they were not immigration officers so I didn't understand why they asked to see proof of legal immigration status. The only reason I didn't raise a ruckus was because I had to take the exam ASAP and I didn't want this 'drama' to affect my mental and emotional state while taking an exam.

 

So are pencil pushers like test proctors allowed to ask for proof of immigration status? There seems to be something wrong with this picture!

Hi! I think it's valid for any agents to ask for our legal status. The only things we have right now is an expired GC and the extension letter. The expired GC itself doesn't grant us anything.

 

I have the similar situation for applying schools and jobs. I need to explain to them that I'm applying to remove condition for GC and the extension letter is the evidence. Seriously, not everyone knows what the letter means and they may even challenge if the letter is real. So, be nice and patience! I think they can even call the USCIS to get validation for the extension letter. I hope it helps!

I plan to use a lawyer for the citizenship phase. There could be more restrictions on green card holders coming up so I'd rather be done with all the uncertainty. More power to you if you don't feel like having to prove the bonafides of your marriage yet again.
