My Cuban husband would like to petition for his mom to come visit however he is still holding his temporary status green card, AOS will not be filed until next summer. I have a few questions:

  • Am I correct in thinking that his mom will need a B-2 Visa?
  • Can my husband file even is he has not received his permanent green card? or an I file for her?
  • What is the process? Does it begin with us filing a DS-160 from here and then scheduling her interview in Havana?
  • Are there any documents she would need from us?
  • Has anyone had success in a Cuban relative receiving a visa to visit and not to live?

Thanks!

She has absolutely no access or familiarity to a computer so I would fill out her DS-160 from here and send the confirmation page with a friend traveling to her city. I can make the appointment for her from here as well for her interview, print the appointment page and send it as well. Is it a B-2 visa that she is applying for?

My Cuban husband would like to petition for his mom to come visit however he is still holding his temporary status green card (he has a conditional green card which means his permanent residency is in no way temporary), AOS will not be filed until next summer. I have a few questions:

  • Am I correct in thinking that his mom will need a B-2 Visa? Yes. He is a long way off from petitioning her and having her come live here.
  • Can my husband file even is he has not received his permanent green card? or an I file for her? His mom needs to file her own paperwork. You have no input here.
  • What is the process? Apply for a visitor's visa like everyone else. Does it begin with us filing a DS-160 from here and then scheduling her interview in Havana? She needs to file the application herself (although you can help her fill it out manually).
  • Are there any documents she would need from us? None at all. It's all on her.
  • Has anyone had success in a Cuban relative receiving a visa to visit and not to live? Sorry, I have no experience with this. :)

Thanks! Good luck!
