Hi guys,

Hopefully I can get some advice here. I sent in my paperwork for AOS, EAD and Travel Card and it was received by USCIS on July 28th 2016. I received my MSC numbers but they do not work on the website. A few days later I received a letter confirming NOA1 for my travel document but other than that, I heard nothing until last week.

I called USCIS last week to ask if there is anything I'm missing and I was told that I should call back in 2 weeks as my number is still coming up as invalid. But this weekend we checked the mail and there was a letter from USCIS with a post-it note on it with our apartment number (they normally do this if the mail gets delivered to the wrong box so they put it in a pile to get it to the right box).
I opened it and my biometrics appointment was scheduled for August 18th (about 3 weeks ago...UGHH somebody decided to hold our letter for weeks rather than returning it to the right box right away). I went immediately this morning to try to do a walk-in appointment (as I read a few late walk-in success stories on here) but I was told that they 'don't take walk-ins' (this is the St. Paul, MN office by the way) and they set a new appointment for October 7th.

Now I was happy to have it rescheduled rather than my petition being 'abandoned' but I was hoping to get my EAD at the end of October (3 months from the application) but now I'm doing biometrics in October. So i'm afraid this will push back my EAD processing. Money has been so tight right now this makes me want to cry that i'll have to wait even longer before I can contribute.

Please let me know if the biometrics will postpone the EAD and if there is anything else I should be doing right now.

  • On Oct 13th AOS status was updated to say that a notice was returned due to post office being unable to deliver it. Tier two told me that it was biometrics or NOA1 (even though I had received both before this date).

  • A few weeks later I received a notice dated Nov 10th, in regards to my call about the Oct 13th notice. The new notice said that there were no RFE's or withholding on my case. So still not sure what this Oct 13th notice was about.

  • Received a letter from a NY office on Dec 23rd (dated Dec 10) stating that my medical was over 1 year old. (At this point my medical was only 7 months old)

  • Teir two submitted an internal service request to which I got a response telling me that I need to respond to RFE ASAP

  • Submitted another service request on 1/6/17. To which I got a response on 1/19/17 stating that my case was pending and is outside of processing time (no mention of RFE)

Yes, the EAD processing will be completed after biometrics. EAD takes 75-90+ days usually, you can expedite it with a job offer.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Hey Jess.So yes it will delay the EAD/AP. I'm so sorry this happened to you :( However you never know how fast they will be, So it may be much quicker. Also I have seen Ead approved very soon after Bio metrics. The immigration officer may be already ready to issue it and is just waiting for Bio metrics.also there is an area on this website that shows processing times here

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
