Timeline

My fiance, who is in Australia, and I are planning to get married and we've been researching the process. I was delighted to come across this very helpful website. We have not met in person, and are planning for him to come and stay with me as soon as possible - we hope, next month. It's reassuring to have found this site because, as I look at the process, I know we are going to have questions. Hopefully, we will one day be able to share our successful experience and help other couples here! Thank you for everything you do!

1) When were intending to get married and where? It makes a difference.

2) What kind of visa is your intended husband coming to visit you on? Also makes a difference.

Based on your answers you might be in for a shock about what you can legally do and not do and when you can do it. That fact that you haven't even met in person is a Big Red Flag.

We are planning to get married here, in New Jersey. We are going to meet in person, when my fiance comes - hopefully, in October. He is going to come on a passport, stay for as long as he can. Then, he will go back to Australia and we will begin the fiance visa process. While he is here, we will be sure to take photos and do many things together so we can have receipts and pictures. A friend of mine is a Deacon in the Episcopal church, and she has agreed to perform the marriage whenever we are able to do it. She will write a letter, on the appropriate letterhead, stating this. Thank you so much for your very quick reply!

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Ah, that makes more sense. So this is a first meet trip and then he goes back and you start the K-1 process. Welcome to the forum. Make sure to read the guides. You don't need a lawyer to do this and it looks like you already know that you need plenty of evidence of your relationship. Save all receipts, include family members in some of your pictures if you can. Let us know how it went after his arrival.

Hi, everyone, and thanks again for your kind welcome and encouraging words!

My fiance was finally able to visit me! He came from Australia on October 11 and was able to stay for ten days. We had a blissful time together and took photos, which are time and date stamped. We also have his plane tickets, boarding passes and bus tickets to prove that he did travel here. We have known each other for more that a year and a half, and in that time - via video chat - have published a book of poetry together and written and produced a song, both of which are available at Amazon. In addition to hours of video chats each day for almost a year, I'm hoping these things will prove that our relationship is genuine. too. A friend of mine, who is a Deacon in her church, will perform our wedding whenever we (and the Visa process) are ready. She will provide us a letter, on church letterhead, to this effect.

The only thing I am concerned about is the income requirement. I am only partially employed, as an independent contractor (music teacher) right now, and my income doesn't meet the requirement. I was laid off of a job as a chiropractic assistant in May and am looking for full time work now. Before the chiropractor job, I was the music and art teacher in a private school for 22 years, but my program was cut by 40% because of budget cuts. I do own a house and have a mutual fund.

Is there a way this can work? Hopefully, I will be fully employed soon.
