My family has suffered over the past 2 years. My wife, who is from Thailand now needs to be sent home due to drug addiction and problems with her network of Thais here in the US trying to drag her deeper in drug addiction and even into prostitution. Now it is time to file her change of status and I am going to refuse in order to save her.

My desire is to make it possible to come back without permanently destroying her chances and I believe this will force her back, but give her the option of re-applying. If anyone knows about this subject please advise me.

In addition we are still married, so my understanding is this will preclude her from being able to argue against deportation. Is this correct?

She is not going to get deported if that is what you want. It is too expensive. She can file I-751 without you. If she has problems with her friends wouldn't it be better to send her to treatment and move to a different state to get rid of them instead of trying to play games with her legal status in the US?

If she leaves and does not file ROC her LPR will be cancelled. She can be petitioned again.

She is only going back to Thailand if she wants to go back to Thailand.

I realize she can file without me, but they are not going to grant it if I have not signed it right? Acording to the law, the fact that she is a drug addict and a part time prostitute of which I have evidence of, would make it extremely difficult for her to make a challenge on any basis. Her immigration status is my only tool and I am doing so with complete agreement from her parents. My attorney already explained that her involvement and the evidence I have of her involvement in solicitation will preclude her from being able to mount any defense. Just wanted a second opinion.

She can file by herself with a divorce waiver if guys you plan to divorce. She must have evidence of entering the marriage in

good faith and co mingled evidence.

I agree, going back home is probably the best for her, away from the drug scene, unless she is willing to rehab here.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

My original question was about re-petitioning. If I understand the reply, if she leaves, without overstay, we can successfully petition again. Your advice maybe accurate, but the basis for having her deported is so she can get the help she needs, whether she is willing or not, which she is not willing.

In addition, she does not have the knowledge, finances or capacity to even find a lawyer much less mount a defense. Finally, there is the children and as long as she is tweaking in the house in their presence, she is endangering them.

She is done here for now, the law is on my side and I will spend every dime I have to get her the help she needs. If I give in, I will kill my daughters mother through weakness.

Since she is a drug addict and a part time prostitute (Crime Involving moral turpitude), you will have a very hard time to petition her back to USA.

You have to submit an extreme hardship waiver on YOU if she is not permitted to immigrate.

Another thing you need to think about, if you do what you're planning to do her so called friends will probably just send her underground and you will lose her forever. Leaving her to them to do as they please.

If you want to help her and your marriage get her into a treatment facility now. If you don't care then leave things as they are she will disappear.

Prostitution is a crime of moral turpitude,she will be in trouble if USCIS finds out.

Look addiction is a disease, but prostitution is a choice. Don't tell me she became a prostitute to pay for her drugs,because there are many people addicted to drugs and they didn't get got involved in prostitution.

Do you think just because she returns to her Country the addiction will disappear? It will intensify even more there . She will never be clean without a properly treatment and a serious change of moral values.

Sending her back to Thailand certainly isn't going to solve the prostitution issue nor the use of drugs (yabba).

She's an adult and needs to take responsibility for her actions.

First off, her friends are not going to protect her. They are scared shitless of me. The thai counterpart has already been paid a visit from people I lnow in the thai police. She is on the run for human trafficking. She is no longer working "escort/massage" here because the people she worked for is scared shitless of me. They would already be un jail if the pasadena police would follow up with arrests. My PI handed them an arrestable case, but nothing has been done.

I agree about the rehab facility that is why she is going to a facility in Thailand that is ranked in the top ten in the world and was recommended through MAYO clinic in Phoenix.

As far as the life change, that is up to her. I can only do so much, but she cannot take her I 693 test until she gets clean. I know a lot of people disagree with my idea that she is a victim, but she did not use and was not involved in prostitution for the 6 years I knew her prior to having our 2 children, it was only after she went to work for a Thai owned japanese restaurant in Chicago. Within in a month she was on meth heavy, had a personality change and had started working for a "sexy massage" shop. I am not done with them yet, hell is where I am going to put them.
