Fiance lost citizenship through divorce, now wants to marry me, age gap (split)

I'm assuming what happened is:

2007 conditional green card

2009 conditions lifted

GF and/or OP have misunderstood lifting of conditions to be citizenship.

But then what explains the reversion of "citizenship" to "permanent residency" by the divorce judge and his referral to her as a US citizen right now? :rolleyes::no:<_< Someone's gots some 'splainin' to do. :whistle:

I love when people come here begging for advice and when given the correct information they argue because it isn't what they want to hear.

OP: If you don't want to listen go ahead and hire that immigration attorney and them come back and tell us how much he charged you for telling you the same thing everyone is telling you hear. Then you'll be crying because he ripped you off!

yes she lost the citizenship for divorce her ex husband. Because he wasn't agree to divorce and he hadn't sign any kind of divorce proceeding paper. Even he don't hire any attorney for himself while the divorce case was running. It was happend at Michigan, USA

Impossible, no way to loose her citizenship because she divorced him

"In cases where the spouse or child loses his or her citizenship, the spouse or child loses any right or privilege of ​U.S.​ citizenship which he or she has, may have, or may acquire through the parent or spouse’s naturalization. The spouse or child returns to the status that he or she had before becoming a ​U.S.​ citizen.​"

I hate to say this but there was Fraud here and the OP is not giving us all the details im afraid, however this may not be his fault as his new beau likely is not sharing all the pertinent details of her past marriage. This is indicative of this persons culture though which is to withhold information to make the situation seem more in his favor. The divorce in and of itself will not result in divorce.

The de facto answer is this:

If by any chance they find out that you received your green card and subsequently citizenship through fraud, then they (she) can lose her citizenship. It is very rare and the burden is very high on the government, but it has happened before. Again, if no fraud, there should be no problems.

So for her to lose her citizenship though divorce then she / he committed fraud plain and simple!

I would ask your girlfriend for a better timeline of events. She may just not understand her current status and is in fact just a permanent resident and never was a U.S. citizen. It's never possible for a divorce itself to lead to loss of citizenship, and it's definitely not possible for a State court to revoke someone's U.S. citizenship. Does she have a "naturalization certificate" or does she recall ever applying to be a citizen, or does she think that she became a citizen automatically? Does she still have her permanent resident card and is it valid (not expired?).

You need to figure out her status before proceeding with any immigrant visa for you anyway. If she is still just a permanent resident, it would be faster for you two if she were to naturalize before petitioning for a visa for you.

Down the road: The age difference won't be a major issue, but it may come up. Keep records of your relationship so you can supply evidence of a bona fide relationship when it comes time to begin the process. Good luck!

Op, did the ex-husband suddenly lose his citizenship around divorce time? I don't believe this very important (but strangely omitted) detail happened at all but could you confirm/deny?

There's a statutory period by which a green card cannot be revoked if it was received through AOS. It's possible to lose U.S. citizenship if you willfully misrepresented a material fact on your application though.

Edit: OP's girlfriend came on a K3 though.

I really think she just doesn't understand her status...

I really think she just doesn't understand her status...

But the factor that instigated the reversion of the citizenship is supposedly the divorce and nothing else. Something's still not right. All these other scenarios we are coming up with were simply not mentioned by the OP. :)
