ditto, that's what I was thinking, that maybe he's confused or doesn't know the terms

she could have applied based on the 3 year rule, but because she wasn't eligible to get citizenship due to divorce, she has to reapply after 5 years of being a GC holder

but reading the post again, they have been married for so long and they just got divorced this year so she was eligible to get citizenship, but not in 2 years of being a GC holder, something doesn't add up here

How did she enter in 2007 and get citizenship 2009? (2 years)

Hes not telling this story correctly.

And had she been married 9 yrs how does some family court judge strip her of her citizenship?

Could it be she applied and failed the test and has to reapply? This is the only scenario i can think that would allow her to no have citizenship and keep her greencard.

IF ANYONE knows another one please tell me.

This story smells bad!!

OP if you dont know her citizenship timeline i belive that in itself proves you dont have a bonifide relationship.

she lost her citizenship and she get back her past green card and as per court order she can apply for U.S citizenship anytime again. but she have to follow all the rules to get citizen like a new U.S ciziten applier.

That's not the truth. She's lying of she said that. We live in America and it has never happened. What's your native language and I'm going to translate to you in a private message. Most people on here divorce and marry other people and nobody looses their citizenship. It never happens

If someone is already a US citizen, I don't see how he or she can lose that status through divorce unless USCIS deemed that the initial green card was obtained fraudulently.

Something about this story is not right.

The above is correct. If she truly had US citizenship, the only way to loose it is if she got it fraudulently, in which case you will have a huge issue getting approved. Most likely she got her 10 year permanent greencard in 2009, and never applied for US citizenship.

yes she lost the citizenship for divorce her ex husband. Because he wasn't agree to divorce and he hadn't sign any kind of divorce proceeding paper. Even he don't hire any attorney for himself while the divorce case was running. It was happend at Michigan, USA

You are not listening. If she was legally granted US citizenship, she doesn't loose that through divorce. Get your facts straight before you embark on an immigration journey. Find out if she ever got US citizenship or what her actual resident status is like. This is gonna be critical to your potential visa.

I have a divorce under my belt and also got my citizenship 15 years ago -- the only thing I lost was my fish tank, savings, some sleep and an ex. I have walked away with all that I needed and cared for, my kid & peace of mind (and yes, my citizenship!). My citizenship never came up during the divorce proceedings nor would it ever come up!

There are some rare cases where a naturalized US citizen can have his/her citizenship revoked. I agree. This definitely does not seem possible nor likely. It sounds like there is a miscommunication going on between either you two, or between her and USCIS. They don't just strip you of your U.S. citizenship even if you were naturalized for a reason such as divorce, it would have to be something very severe and significant, and like previously mentioned there is almost no way they would just hand her a green card after that if that is what actually happened. Maybe she is and always has been a legal permanent resident, I'm not really sure but there is definitely a form of miscommunication or misunderstanding going on here. As also previously mentioned, the age gap doesn't seem to be an issue as long as you can provide evidence of you two having a legitimate relationship such as pictures, constant communication, (skype, viber, whatsapp, facetime, facebook,etc) and evidence of any visits to the U.S. or to your country on her behalf. (think passport stamps, itineraries, flight tickets/boarding passes,etc)

And what it boils down to us no one here can really help you since we don't know the status of girlfriend and since the story you've given makes no sense no one can answer your question about visa approval since the situation you've outlined is just not possible. So no, we can't ignore the whole citizenship thing because you're entire chance of being successful depends on the truth.

I'm with everyone else here. Something is off with the inquiry. Either the GF is sketchy, the OP is about to enter a fake, not-bonafide marriage or we're all misinformed and it is really possible to lose citizenship within the timeline explained.

1. She has very bad English skills and doesn't know what she's talking about

2. She's naive and believed lies her ex husband told her about her immigration status

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

2024: FML. Seriously. I'm done.
