AOS W2 and tax return questions Help Please!!

Hi,

So my im filing for aos and my husband does NOT have W2's for 2013,2014 he only has W2's for 2015. It's not that he dint work or file taxes(btw has tax returns for all 3 years) he's changed jobs, moved couple of times and lost copies of the W2's for years 2013 & 2014.

My question is is it okay to submit tax returns for 3 years but W2 only for 1 year(2015)? do we HAVE to submit W2's for all 3 years? OR

Can we submit Tax return and W2 for 1 year only? will submitting proof for only 1 year weaken our case ?

Why don't you just order the tax transcripts from the IRS? This way you don't need to deal with tax returns and W2's. You can get the transcripts online.

If we attach Transcripts for 3 years from IRS do we not need to send W2's and tax returns?

Also i was just reading the IRS page can i submit the transcript that we obtain online or we have to select the option where they have it mailed to us? We are running out of time as my F1 status expires on 29th sep 2016

You can use the tax transcripts you can pull from the website online. You do not need copies of tax returns and W2's if you submit tax transcripts.

I have added my income on the affidavit of support with him, do i need to submit returns and w2 for 3 years or i can submit for 1 year?

nope, we were not married when we filed taxes. so we filed seperatley

You have worked here on F1 visa and USCIS will not accept your income unfortunately even though you have filed and paid taxes. You may get an RFE if your husband's income is insufficient, sorry. :(

You can send either 2015 complete IRS federal income tax return transcript or for last 3 years, it's up to you pretty much.

You have worked here on F1 visa and USCIS will not accept your income unfortunately even though you have filed and paid taxes. You may get an RFE if your husband's income is insufficient, sorry. :(

Hey thanks for the response! So my husband made more than the required 125% for household size 2. But we just want to add my income for added benefit.

Are you sure uscis wont accept my income > ?

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes I am sure. I've worked here as a teaching assistant for 5 years and my income was not accepted even when my husband and I filed joint tax returns for last 2 years.

It's USCIS. Lots of things make no sense but if you are planning on submitting tax transcripts, w2s are not required but recommended to help IO separate your income from your husband's... pretty much send everything in :)

Ok, im confused now.... So you are saying that i should not add my income on form i 864 which my husband is filing? <refer section below> but i still should send in my w2 and tax returns?
