Hello everyone. I need a little help and don't know exactly what to do. I have been married for about 3 and half years. During that time me and my wife have lived together but not had up until this time any joint accounts. She"s on my credit cards as authorized user . We have been taking care of my father since my wife came to America. We live with him no utilities are in are name. We do everything for him jointly and because of this pay no rent.
We don't have contract to do this. So far we have submitted pictures of us together, affidavids from about 3 sources testifying as to our marriage being bonified. life insurance policies showing other as benefituaries. My wife has now been working for about a year. She now has a ss card. We were recently at the uscis and they stamped here passport with a greencard stamp for one year. We have until nov. to submit additional evidence. My question is can we get some kind of statement from my father to submit to say that we have been taking care of him and submit it? if so what might I include in it. I also have poa and recently got a statement from his doc saying he cant live alone. he has dementia slightly and cant live alone. We are planning on sending in a copy ofher drivers licence which she will receive in 3 days, a statement from her employer showing her address, time working and me as a emergency contact. We will also send in some more pictures which shows us together throughout our marriage, travel fotos, and passport pages showing traveled together, fotos of showing us together in her home country during the holidays last year and screen shots of e-mails and facebook post. I will also send in copies of last 2 years of tax returns showing us as filing jointly even though I have yet to file this year because we don't owe any money. Any suggestions, would be greatly appreciated.

Welcome to the forum.

This is a recent common issue with USCIS, these forum pages are loaded with folks with very similar issues, including ourselves last year....needing to provide more "marriage bonafide evidence." We scoured everything we had, all total we ended up sending in almost ten (10) pounds of paper evidence with the initial and subsequent RFE response. As has been often mentioned in this forum, getting wills, POAs, and living wills crafted for each of you is a good thing now, and in your life together. We had a good experience with legalzoom.com YMMV.

Because you have not sent the tax return jointly, I think that will be a strong proof for bonafide relationship. Anything with your name, your wifes name, plus address on the official statement will be a good thing to sent. Wish you luck for the ROC!

OK - definitely add your tax returns. Do you have medical insurance? Do you have a car or car insurance? Can you write a short paragraph and explain why the two of you have not combined banking accounts? USCIS seems to expect that couples have joint accounts, and there are MANY reasons why two people might NOT want to have combined accounts. Sometimes USCIS just needs to hear that reason from you.

And...send in a letter saying that you will not owe any taxes for 2015 and that since you didn't earn enough, you were not required to file. This will be important.
