Termination of Immigrant Appn.

I am USC. I applied for an immigrant visa for my mother a couple of years back. However, the process had been stalled for the last year or so due to the non-availability of my mother's birth certificate and my dad's death certificate. I had sent in affidavits but I keep getting letters from USCIS to provide them with Birth and Death Certificates. In India, getting these certificates seems to be really difficult and time consuming.

At this point, I am frustrated and would like to withdraw my application. I have received a letter from USCIS addressed to my mother, if she would like to withdraw her application.

Can I, as Petitioner, sign that letter and send it back to USCIS or does my mother have to sign it?

After this application is officially cancelled in the system, my mother would like to apply for a visit visa at the US consulate in Chennai, to visit me here in the US for a couple of months. If anyone knows what is the process for this, I would appreciate if you share your ideas on this.

I heard that if she applies for a visit visa now before the Application is withdrawn, her visa application will not be approved since she has a immigrant visa application also in the USCIS system. They might think that she is trying to immigrate through the 'back door' so to speak.

How long does it take for them to officially terminate this application in the USCIS system after I send in the letter?

You can withdraw the petition, and then send a copy of the withdrawal notice with the tourist visa application. Due to having had an immigrant petition, and there being problems with it, she will have a difficult time getting approved for a tourist visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
