Hi guys, I just need some help with I-864. My husband's income is just a couple of hundred less to pass the requirement for 3 members so we would like to use a joint sponsor which is his stepdad and mom. They all live in the same household but he files his tax return separately. My questions would be, should we write his parents's name in his I-864, Part 6? Which form should his parents use, would it be the I-864a?

No you would not write them n Part 6. They live together but they aren't part of his household size.

Step-Dad files the I-864 and mom I-864A.

Now your husbands household size is him plus you. Your parents is them plus and dependents they claim on taxes and you.

Can some one explain to me, if you use your tax return and w2's did you print all 100 plus pages for tax return? or did you print only page with adjustable gross.

and when filling out your form I-864EZ did you write N/A in all the unanswered lines like the one about mailing/physical address and page 7 which speak of more info, if you have none. thanks

If you submit tax forms you must submit every single thing you submitted to IRS. This is why its strongly advised to order your tax transcripts from IRS. It has everything submitted alot less pages.

Hi everyone. Is it true that Mexican petioners don't need the police certificate? My lawyer haven't sent it because she said I don't need it. Does someone know something about it? We got a checklist after 8 weeks waiting. And NVC only ask for my divorce marriage that they said it wasn't included on the documents. But they didn't say anything about the police certificate. Can they make a second checklist? I'm very nervous about it. My husband says that NVC should tell us that it was missing too. What do you think? Thank you!! I'm very frustrated about all this and I know you are the only people that understand.

I just got a checklist saying that we applied for a waiver of unlawful presence and that has to be decided before they can process our case... my husband is laughing at the idea that he's already in the US! I really hope this can be cleared up with a phone call! The checklist says the NVC got notice of the supposed waiver application from USCIS--if the mistake is actually at USCIS, and NVC really did receive notice of a waiver application for my husband, this could be a MESS.

I don't know if I'm going to be able to sleep until the NVC opens!

It seems like these basic "we sent this to the wrong person" errors happen WAY more often than is reasonable. I understand that there's a lot of paper and a lot of numbers moving around here but...

Hello September!! I am excited about the new month with new hopes. I will be in the NVC stage soon as they receive my file and i was getting ready for it. I had a few doubts on the way. Can anyone please let me know what to do in this case. My wife is petitioning for me and will be taking a leave to come to my home country until my visa process is completed.

So i wanted to ask as she has to file I-864 does she have to show that she is working and show the current income even if she is on leave or she just files it as zero income. As the co sponsor her parent already meet the income requirement so we just need to file a separate I-864 for them right ?

Please help me with my doubts.

Thanks.

Is your wife leaving her job or just taking a vacation? They are mostly concerned with 2015 income since it is the same income unless it changes then she needs to explain why her current income is different.

If she is using her parents then they can only fill out i864 if they are not living in the same house as her. Otherwise it would be best to use i864a.

Hi. Thanks for your reply. My wife would be either taking a leave or she will be offered work from home. And yeah she lives with her parents so what should i file as current income for her and what forms does she file for her parents as co sponsors?

So here is my question because I have 2 different responses from nvc when I sent my papers in august. When I called on August 8, they told me they received my documents on August 5 (they didn't update until August 8) and to wait 6 weeks from the time they received my documents. On August 10 I got an email stating they got my documents on August 5 and to give them 30 days from the day they received it since there is a high volume of cases to be reviewed (the letter stated that)

Should I call in 30 days or 6 weeks? It is very confusing.

Is she is not leaving work and her current income is still the same as 2015, then she files i864 with her current income as normal information.

Since she lives in the same house as her parents she needs to have her parents file i864a (she can do for both or one, it depends on if one meets the requirement then one should be good). She has to show in her household that her parents are included if she does i864.

I did i864 for me and i864a for my brother as I am taking his help. According to instructions on the nvc and on uscis for i864a, the person has to reside in the same house and is relative of sponsor. So I think it applies to u.

Do you mean Mexican petitioners (the American spouse) or beneficiaries (the Mexican spouse)? If you're really asking about the petitioners, none of us need to send a police certificate.

If you're asking about the beneficiary/applicant, I don't know anything about the Mexico process, but according to this page it does appear to me the certificate is available and would be required: https://travel.state.gov/content/visas/en/fees/reciprocity-by-country/MX.html (go down to "police/court/prison" on the left tab)

I think there's a Mexico-specific forum in the regional section where you can find people with experience in that country. There are some countries that don't need police certificates at this stage, like Pakistan and the Netherlands, because of variation in procedures in those countries.

I am sorry I am not familiar with the I-864. I did the I-864EZ. Hopefully someone else can answer your question.

No you would not write them n Part 6. They live together but they aren't part of his household size.

Step-Dad files the I-864 and mom I-864A.

Now your husbands household size is him plus you. Your parents is them plus and dependents they claim on taxes and you.

Thanks MrsBurgz and dwheels76! :)
