I need help and advice.  My noa2 was sent with a processed date of 3/10.  Tomorrow makes 6 full weeks and NVC still has not received our case.  I'VE called USCIS and they are going to do a research but I won't know anything until sometime in May.  Called NVC again yesterday. ..this has been 3 -4 times a week and they still say they have not received our case.  Yesterday the guy says give it two more weeks.  Everyone that received their notice around my time are already processing their NVC case.  I'm stuck and I don't know what to do.  Any ideas or suggestions?

Did you ever receive a message from the USCIS saying your case was sent to the Department of State? You said you called a Tier 2 Supervisor; did they mention a specific date your application was sent?

Make sure to check the box on question 20 of I-864 form (I was not required to file a federal income tax return as my income was below the IRS required level and I have attached evidence to support this.). You need to do more then just write a letter. I would include:

  • A letter explaining your situation.
  • Some proof that you were a student for the entire 2014 year.
  • Some document from the IRS stating what was the minimum income below which you are not required to file taxes.

Thanks. Another questions is about join sponsor name: his name on Naturalization Cert is Phi Nguyen Nam Le, and on his tax info Phi N Le. So, how we will put his name on i864?

My personal advice is that always go by your civil documents (Nat. certificate, birth certificate, passport, driver's license etc.). You can always change/update your name with IRS.
