They expidited my process for name change which was updated it in two days. You have to call to make sure they took care of it and you get an email that says your name was updated. Don't wait for the NVC level because then they will ask for proof which will delay your process. Good luck!

No problem! I was freaking out when i found out i waited 6 months to get an approval and they spelled my name wrong 😩

Yes, I can imagine! Same for me and what is even more frustrating is that I already submitted TWO service requests to have this revised and they still didn't correct it prior to approving the case 😩. My husband's name was spelled correctly at least 30-40 times on all of the documents I sent and they still managed to enter a typo.

Yea i've realized they don't even pay attention to detail. We wait months and they can't even spell names right. 😡

So I wanted to reach out and see if any of you all have considered this move:

 

I've read and spoken to a lawyer about the ability to Have my wife fly over on an ESTA once our I-130 is approved so that we could adjunct the process and file a I-485 so that we can be together throughout the remaining process. She came and visited in January for about 40 days, so we know its possible to get in during the process.  I'm just shaky on the eligibility of filing for the I-485.

 

What are peoples thoughts on this? Has anyone gone this route?

If I understand correctly what you are saying, you cannot apply for adjustment of status on an ESTA unless you can prove you have no intention to stay permanently. There is an exception to being able to do it if married to a US citizen but the rules of  immigrant intent contradicts this. If she wants to stay on an ESTA and then leave and continue consular processing at home that should be fine. I entered after applying and it was never mentioned when I entered. They do have the right to question you though to make sure you're not planning on staying. Is this what you are meaning?

From what I've read though, all you need is a lawful entry after the I-130 is approved in order to apply for the I-485. 

Just to clarify, I'm the USC. 

 

I'm trying to get clarification as to if side-stepping the NVC and heading the route of status adjustment is truly possible.

today I just got notification via sms (x3 again!) and via email. Checked USCIS  and now it shows case sent to Department of State. 

So, you're good! Guess someone skipped the approval notification and just sent your case off !

Hi everyone I'm also a September filer and new to this. My Noa 1 was sent to Nebraska and received September 26. On February 16 it was sent to Texas and currently still waiting for my approval. This has been the most frustrating process I have ever experience. I called today and was told that I'm still on normal processing time and to call back in two weeks if it's not approved by then. I traveled to visit my husband in February thinking that the next time I went back to see him, will be the day of the interview but the way this is going it will be a long time until then. :(

Congrats!!  I keep calling NVC for confirmation of case received but still nothing.  Hoping I can get a case number soon!

Since you're doing Canada, I think you can e-file so I have a feeling you'll be speeding through now :)
