That's a very long time since the delivered date. They should have assigned a case number by now or in worst case, send the entire packet back like they did for someone in the forum by sending his USB drive back that they didn't need.

Did you mail the packet to the right address and right forms for I-130?

Looking at your case history, it looks like there were multiple denials. Not sure if that has to do with submitting incorrect forms or other issues. That might be what's causing the delay.

Since it's unusual delay, you may want to contact USCIS for assistance.

Actually our first K1 Fiance visa took less than 6 month (March to June 2002) and by September 2002 we were married and starting our life together in USA. I (the wife) am from Argentina.

The following steps went pretty smooth also until the second green card which was issue with the last name misspelled. Even thought after another 6 month USCIS finally fixed the name in the card, that error followed us for a while. Actually two years until they completely removed it from our case.

We filed for Citizenship in 2008 and was intermediately approved, after doing the biometrics 3 times, we were supposed to have the interview in the following 3 to 6 month.

We visit Alaska felt in love with the State and decided to move there. So our case was moved from Texas to Alaska. After a year we were told our physical file was lost. That took another two years until we received a notice from USCIS. But still pending.

We came together to Argentina for 4 years term informing USCIS on the basis of:

9 FAM 42.22 N1.12 Lawful Permanent Resident (LPR) Students Studying Abroad (CT:VISA-1377; 11-24-2009) Several decisions by the DHS Administrative Appeals Office (AAO) relate to LPR students studying abroad. Students who wish to retain LPR status should present evidence of a definitive graduation date. Even prolonged absences from the United States may be considered temporary if the LPR can present evidence of a receipt of a degree within a definitive time. Consular officers should take into account whether students return to the United States at the end of each academic term, or whether they have family still living in the United States. Evidence of property ownership, or a bank account in the United States, may indicate the student intends to return to the United States upon completion of studies.

I (the wife) as a LPR enrolled at the University in Buenos Aires and finished the degree in 4 years.

Once we informed USCIS about moving temporally to Argentina our N-400 case was closed. We expected it, we knew the rule.

The same year of Graduation we applied for Reentry Permit at the embassy on the basis of 9 FAM 42.22 N1.12 . Our case was Denied. By 2012 Fam rules had changed. We were advise not to fight the embassy or USCIS for ex post facto law because it would be a waste of money and time.

In order to start all oer the process the Green Crad has to be abandon. Make an appointment to Abandon the LPR status and start over again as soo as possible but it is taking quiet longer than what we expect.

My husband and daughter are US citizens so they can go back at any time, but we do not want to be apart. We keep our ties to US, never stop paying taxes, and kept our domicile in Alaska.

That our history with USCIS.

I email my lawyer to find out if she hear any thing as yet and she said no. I don't think she file the G1145 as I told her to.

My package was delivered from 09/16. We don't even know if they accepted the package or return it back.

I guess that's another kind of price you pay to go through a lawyer. :)

Updated the team.
Revised what we track on the list. Since most people move on to the NVC and Embassy section of VJ once they have case approved at USCIS, I have changed the list to track cases up to reaching NVC. This way, our list will provide more details on USCIS portion of the cases. This is what's changed on the new list:
  • Removed Case Complete and Interview dates
  • Added when NOA2 was received in the mail after the approval
  • Added how many days it took for a case to get approved from the NOA1 date.
Looking forward to your suggestions.

I don't understand. I'm trying to find out when did you get 212? you said last year. Then it means you were applying for something last year right? I'm asking because I'm curious if this is the second time you are applying for your immigrant visa. I don't care why you got your 212 if you are worried about that )))
