@kackandnico - agreed! VJ in general is awesome, and September group is the best!! This would not work without people checking in, sharing their experiences and asking questions.

There is absolutely no rule against applying for a tourist visa. However, be aware that one of the key requirements for getting a tourist visa is to prove that you have NO intent to immigrate to the United States. Generally, this is quite hard to do, since you've applied for a spousal visa, which is an immigrant visa, and basically tells the US government that both your wife and your daughter want to MOVE to the United States. For this reason, you will likely be denied. Even IF you get the tourist visa, the customs officer at your Port of Entry into the United States can deny your wife and daughter entry.

 

However, if you have no problem spending the money and dealing with the potential heartbreak, feel free to apply. Your wife and daughter will need to provide STRONG evidence of ties to their country and that they intend to return back to their country. Finally, even if they are denied a tourist visa, this should have no bearing on their I-130 application.

It's not a stupid question and the answer is no. They will not give it to them because you have already filed for them.

 

 

if you did apply for tourist first before filing for them then maybe they would have getting it.

 

 

 

And in top of that once you apply for tourist visa they will know you filed for your wife and Daughter.

I seriously doubt it, just because you have I-130 filled already. USCIS already has their Info. You have declared your intention to relocate your family to the USA permanently. I-130 is in process, they are working on it. Any other route might look suspicious to USCIS, plus all extra cost with no guarantee visa approval. Just like others have suggested " Patience is the Key " Your family would be approved and join you before you know it.... All the best. Good luck.

Updating this table to include my case complete at the NVC. :D Today also happens to be my birthday, and I couldn't have asked for a better birthday present. :D 

You can check out my timeline on my signature below to give you guys an idea about how long the NVC process has been taking these days for people who go through the regular process (electronic processing is way faster). As soon as you get your case approvals, get on with your NVC papers right away to save time. 

 

I will be updating next with my interview date as soon as I have it and will let you know in case I encounter any unconventional stuff so you guys can prepare ahead of time.
