Waiver?

I am confuse if my fiance needs a waiver . Im the second woman he petitioned after 16 years. We didnt include it in the packet. Just worried about an RFE. Any thoughts? Thank you for reading.

It's possible but usually it's if they peitition for a second k-1 within something like 2-3 years of the first one.

Now USCIS may do an RFE in question as to what happened with the first K1 application and beneficiary and then may want to ask for a waiver but can't say for sure.

It's been 16 years, I would think your fiance would be free to file again.

i received a RFE and it was for not explaining where we met online.. the whole IMB thing.. the delay was for 20 days to receive letter, send, receive and approved

He doesn't need it, I am the petitioner and this is my 2nd time, the first 1 was CR1 and my 2nd is K1. My wife is here now with me and we filed AOS this year April. As far as I remember on the application, there is a question there asking if he ever filed a petition, if he didn't answer that for sure it will come up as RFE or be questioned on your interview.

Thank you a lot for the fast answer . He answered YES to the question if he petitioned someone before . Now, I don't have to worry of a waiver . They got divorce in 2012 after being married for 14 years . The ex wife was from Columbia and now a US citizen .
