Hello, I have a few questions concerning the income requirements for the K1visa. First, I would like to give some background information. I am 25 my fiance is 24, I graduated with my masters degree in April of 2005. I was a full-time student from 1998-2005. Over the course of those years I have had a number of part-time jobs as well as internships that provided a small stipend. My full-time student status combined with internships precluded me from making much money. I have filed tax returns over the past three years but did not make more than $5,000 in any given year. After graduation I had to fulfill obligations to my last internship which ended in mid-June. After that I found a temporary job that lasted between August and November. I took this ending as a perfect opportunity to visit and spent December in the Philippines with my hon. I have finally been hired this month into a full-time job. The salary is $31,000 with great benefits.

While I have the three years of tax returns, none do not exceed the poverty level. My current income does exceed 125% of the poverty level.

My questions are:

1. Will we have any problems because of a lack of past adequate income? My research indicates that current income is of paramount importance and that I should have no problems. I just want to verify. I can delay sending out the paperwork if needed to establish a history of stable income. I have been thinking that since it will take about 7-8 months for my hon to get her interview, that should be enough time to show stability.

2. Will I need a co-sponsor? I have asked a family member who has agreed.

3. When I complete the I-134 do I need to attach a form stating that my lack of previous income is due to full-time student status and attach my transcripts as well?

Hey there!

I am a recent graduate as well and as we know, any money we ever had has gone to loans! hah ;) I just recently started my full time job which pays above the 125% poverty line and am starting to make my savings account slowly grow. I am not worried about my lack of previous full time jobs...I think that both you and I can prove that we will be able to support our honeys when they come over--the gov. won't have to worry about taking care of them. So as you said, I think that the current income is paramount.

Also, I don't believe that you will need a co-sponsor b/c you do meet the guidelines. You don't necessarily have to worry so much about it now because the I-134 doesn't need to go in the original petition you submit. You'll have to send it over to your fiance.

Lastly, I would just like to say that I am still fairly new to this process so I may be incorrect in my statements. Gosh I hope not! If so, I apologize and we can both learn ;o) If I have said anything wrong, please correct me! I'm just trying to relate to ya and let you know there are others in the same situation.

I am in the same boat, and have a co-sponsor. Just don't want to take the risk of being denied, regulations are regulations regardless of circumstance.

My fiance and I are filling for the K1 visa this month, and he´s still in college, working part time at McD´s. I graduated from Law School last december, and am studying for my bar exam and not working at the moment.

When it comes for the time of the affidavit of support, if it´s before May (my fiance has a job lined up for him right after he graduates in May) he´ll just say he works McD´s, and we´ll use his father as his co-sponsor, but even if he´s employed with a better income by then, we´ll still use a co-sponsor ´cus in these visa things, more is better.

I as well am a recent college graduate (also with lots of loan debt-- do they look at that??). I can't say anything concrete, but I know a friend's K1 was approved while she was still in college and had no job. She did have her father as a co-sponsor. I think just to be safe I'm going to have a co-sponsor because I really don't want to give them any reason to deny me. This probably isn't much help, but just thought I'd throw it out there. :D Anyone, any idea about the loan debt? Is that a factor?
