I wanted to make a post to let other's know (not sure if I'm posting this in the right area), that I asked the Sydney Consulate what their guidelines were in terms of the I-134 and this is the response I got.

I asked:

Do you accept 100 or 125% of the poverty level when using an I-134 for a K-1 visa? My mom makes over 100% of the poverty guidelines, but not the 125%. However, I have a job and with my earnings and her earnings we go over the 125% guidelines for the I-864. I live with my mom who makes 16k a year (she has agreed to support him on the k), and then I'll make about 8-10k a year. In total we make about over 30k a year. It's a household of two, and I see that 125% of the guidelines is 20,025. If we can demonstrate being over 125% of the guidelines because of both our incomes, would my chances of being approved be good? I hope I'm emailing the right place, if not, can you direct me to the right place? Thank you.

The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.

So this is a post to give other's hope that are trying to at least get approved if their income is below 125% for the I-134, just as long as they manage to bump their income up to 125% of the guidelines when they go to file for the I-864. I hope this information helps some.

Most embassies only go after the 100% on the I-134, the problem is people have to have 125% to AOS shortly after marriage and therefore it will be a problem as you say yourself.

Yeah, it's good for those people that are gonna have the income in that short period of time to cover the 125%. Otherwise, it doesn't make a difference.. but say you just needed the amount to get the person approved at the 100% level but then you would shortly after have a new job or something that would bring your income level above 125%. I think if you can get it above the 125% before you have to file for the I-864, it can be a bit relieving since they're not too strict for the I-134. Everyone's circumstances differ, so it's good information.

Yes well it is an option since there isn't a timeline for when to file for AOS.

Hi @amishbaby! I have my K1 interview in Sydney very soon & I wondered how closely they scrutinise the I-134? My fiance is above the 100% requirement but he rounded up his figures on the I-134 form (so, say he makes 24,060 a year - he just rounded up to 25,000 on the form.) So, the form doesn't EXACTLY match his tax return - but it's close. Same with his bank account balance - he just rounded up to the nearest whole thousand. Do you think after your experience in Sydney that this would be okay..? Or do they compare documents and scrutinise the I-134 closely? I also have proof of my own savings & income - do they also take this into account? Thanks in advance for any help

Were still waiting for our NOA2 because we didn't file our I-129F unti March 2017 of this year. I wish I can answer with certainty. But I am willing to bet this will be fine. Trust me. I hope everything goes well for you if you didn't have your interview yet. If you did, I'm sorry I didn't respond sooner.
