Hello all,

Myself and my partner, he is from the Philippines, are a same sex couple who just got our NOA2 from USCIS. We have a while still obviously to worry about this but we are trying to plan a head.

I looked but could not find specifics or the answer to this question so thought I would ask people who had the possible answers.

My fiance and I have talked about after marriage, does he want to change his last name to mine or even hyphenate it. I did not care either way honestly.

We both agreed he would not change his last name after marriage; but I wanted to know would him not changing/adding my last name to his legally be an issue or looked down on during the AOS?

I know in general people don't have to legally change their names but in this instance with the K1 is it better for him to do so?

Thanks all for any information and also for all the great info I have been able to gather since being on VJ.

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

I wouldn't worry too much about that because I also plan not to legally change my last name once married. One of the primary concerns in AOS for a K-1 is that both partners must demonstrate that the marriage was done in good faith.

It's viewed as simply a personal choice wether or not to take the other spouse's last name. Immigration wise, it doesn't matter, so do whatever you decide to!
