Hello,

I am US Permanent Resident. I applied I-130 for my wife in Feb'2016 (F2A category). My wife has already B1/B2 Visa and she is with me here in USA. I will apply for her adjustment I-485 when priority date becomes current.

I just want to know which chart to follow from Visa Bulletin for this purpose. They have 2 charts there. Chart A has 15Nov14 as current date for F2A and Chart B has 22Nov15.

A. FINAL ACTION DATES FOR FAMILY-SPONSORED
PREFERENCE CASES

B. DATES FOR FILING FAMILY-SPONSORED
VISA APPLICATIONS

USCIS might use Table A A. FINAL ACTION DATES FOR FAMILY-SPONSORED

PREFERENCE CASES or Table B DATES FOR FILING FAMILY-SPONSORED

VISA APPLICATIONS to allow applicants filing i485

Each month you have to look into https://www.uscis.gov/visabulletininfo to find out which table it is using for i485 applicants and whether you can file i485 in that month.

If she continues to use her tourist visa to live inside US de facto, the CBP might deny her entry.

Also, it's visa fraud to intend to enter the USA with a tourist visa and adjust status

Thank you all for response...

She got her B1/B2 due to her Medical studies/internships here and USMLE exam. Hopefully she will get her medical residency here next year and then she will get her J1 or H1B visa from the hospital.
