Hi all,

I am in the US on a K1 visa and got married to my wife a few days ago, on day 65. We have a few questions about the AOS process as we are slightly confused and rather overwhelmed.

1. I had my medical in London, I had all the vaccinations needed. it seems some suggest I can simply send in this form of my vaccination record, even seems that way on the USCIS website. However, I called USCIS and they said I need to be seen and signed off by a civil surgeon in the US?

2. My wife and I are students, me not so much currently whilst this is underway of course. So for the I-864 form, we haven't got too much to show. We have 4,000 dollars in assets of our own which we are using for rent, etc. and no other income except student loans. We are thus using my wife's Aunt and Uncle to sponsor us. So to confirm, we need to submit the form I-864 from my wife, and also form I-864 from my new uncle AND I-864a from my new Aunt potentially too? Also, what supporting documents should we use realistically? We were all going to use the previous 3 years tax returns, proof of income from their retirement, proof of ownership of their house and also a bank statement, will this suffice?

3. Lastly, we are running close to the 90 day mark as we are now on day 70 and we have not submitted the packet yet, (we got married so late in the 90 days as we had a lot to plan etc. as we went for our full wedding rather than a courthouse wedding) is it an issue if it submitted after the 90 days?

2. Yes both must complete and submit the form.

3. No, you only have to be married within the 90 days not submit AOS within that time.

Yes, USC petitioner/sponsor files I-864 and then joint sponsor their own separate I-864 and joint sponsor's spouse the I-864A. Do their combined incomes meet the requirement for their household size plus the immigrant? If yes, no need to list assets. If no, their assets must be 5 times the amount they are short on income. If their home is pretty much the only asset they have in that situation, then perhaps you may want to find another joint sponsor that meets the income requirement.

3. Lastly, we are running close to the 90 day mark as we are now on day 70 and we have not submitted the packet yet, (we got married so late in the 90 days as we had a lot to plan etc. as we went for our full wedding rather than a courthouse wedding) is it an issue if it submitted after the 90 days? There is no time limit/deadline in which to file for AOS. As long as you married within 90 days then you are eligible to file based on your approved I-129F petition and fulling the requirements of the K-1 visa. However, you will be out of status and begin to accrue unlawful presence between your I-94 expiring and filing for AOS. Once you file for AOS, you then enter a period of authorized stay while waiting for your green card approval.
