To ALL F1 students applying for AOS question

My question is for F1 students who are or have been in the same situation. If you are going judge and assume things, please kindly stop replying to this thread. You are being very unhelpful and plain rude. I'm in no way an expert to immigration laws that's why I have a lot of questions and ask for guidance for those who do or at least have experienced that same things I'm going through right. Which is what this forum is all about isn't it? So please stop asking unrelated questions just to quench your curiosity.

Thank you for your advice, hence why I gave you a "Like" or "reputation" but where do you get off telling me I think I have special privileges? That's completely baseless and just plain untrue. I've asked multiple people here and in real life if I'm required to enroll as my AOS is pending and most of them said the same things as you. Enrolling would be ideal but not NECESSARY. I know that it would be best to continue to be an F1 student as long as my AOS is pending. I know that but I've decided not to. If I get rejected for a greencard, I plan on going home and applying from the embassy there. I'm asking for people to share their experience if they chose the same route.

No, you think the AOS does not require you to enroll because you are now a married to a USC and no longer have to abide by the F1 visa requirements, the only status you have. Apparently having a USC spouse affords you the privilege/luzury of ignoring the F1 visa requirements. It doesn't. No assumptions, no spun words, no false interpretations. So I will tell you plainly, straight from an IO's mouth, not my "feeling", not what I "think": Register for classes

If she does not want to enroll let her be. Every one situation is different. If she does not get granted AOS she will just have to leave the country period.....

Now Tindera my thoughts to you is to still enroll as you came here with the intend to study. Being married to a USC only gives you the eligibility to apply for AOS. if your AOS does not goes in your benefit at least you will still have a legal status. no one is attacking you on anything they are giving you their opinion.

My husband didn't enroll in the semester while our AOS was processing. We knew once he had his green card he would be eligible for in-state tuition and federal financial aid. Thus, it was an economic decision for us, and the right one. He continued with school once he received his green card.

I was considering this case scenario as well but I applied to be consider a resident for tuition purposes and was approved. So now I pay only in state tuition. Woo hoo. It was a challenge though. My school was kind of against it for a while until I proved them wrong. You should have done it too if you're quilified of course. Edited September 14, 2016 by pilotkausa

My husband did AOS from an F-1 when we got married and he was asked several times both when he used Advance Parole to re-enter the US and during our official Green Card interview if he was still enrolled in school. It was imperative that he was still an active student because he was here on an F-1 visa. Yes, technically once you apply for AOS your status changes, but you WILL get asked if you are still enrolled and currently taking classes. CBP/USCIS ask this to help determine if your F-1 visa application was legitimate and you didn't just try to skip the immigration line...because remember F-1 visa is NOT an immigration visa. When you apply for an F-1 visa you had to give evidence that you had intention to return to your home country. Although I personally find it very backwards that we allow international students to study here and then immediately rush them out the door...that is currently the case...

When I submitted AOS, I was under the F-1 category. I was not enrolled in classes at the time because I was going through the OPT period. I wasn't exactly sure what to expect during the interview, so I made sure to carry all relevant information, such as the I-20, as well as full transcripts for the time I was enrolled in school.

While I was not really asked for any information about school and my F-1 status, I felt it was extremely important to be prepared to show that I valued the opportunity I had to study in the United States, and that I was taking full avantage of the opportunity by studying hard, getting academically involved, and getting good grades
