I am going to ask her she only called n tell me that the hospital said everything that she wants comes from the website but they can't write her a employment letter

How much is she over the poverty guideline? And how many depends does she have?

My husband can't get employment letter either and we have never been asked for it. Just give other proof of the income, the employment letter is often only needed if it's a new job or if the person is only above the poverty guideline.

So I'm a little bit confused. Got married in August and filed for AOS mid September. Had my biometrics interview yesterday but today I got 3 requests for initial evidence.



The first one says that we need to submit all supporting tax documentation for the most recent tax year. As far as I'm aware we did that. Submitted W2, 1040A, 8863, 1098. The request says W-2, 1099, 2555 and all supporting tax schedules. What did I miss? No idea on US tax law yet.



The second one then says that the I-864 doesn't meet the poverty requirements. Last year my wife earned 17k as she was finishing nursing school. This year with her new job (started in June) shes on 63k a year (already earnt about as much as last year in 4 months) We sent in a letter from her employer stating her position and full time hours and permanent etc, as well as her pay stubs up to that point. Will this not be enough or do they only base the I-864 on the previous years earnings?



The third one is bizarre. My son arrived on a K-2 visa at the same time. It says you must submit evidence that an immigrant visa petition was filed on your behalf before filing AOS. Examples include I-797 from an I-129f fiancee visa. This was included in the package with his form and mine and copies of the K-1 and K-2 visa. What else can I provide as he's not named on the I-797 as he's the K-2. It's all ticked on his form that he's K-2 and linked to my K-1.



Any help would be appreciated. Waiting for second line support to call me back but I don't anticipate getting very far so may need to make an infopass appointment in 2 weeks to get some help.

Biometrics done today, at my scheduled appointment time. I was out in 15 minutes.

It was pretty empty after lunch time, just one person in line before me. I probably could have easily done an early walk-in, but after reading some reviews on Yelp about rude security guards, decided not to take chances.

On the whole, my dates (receiving NOAs, bio appt) seem just a bit more spread out than a lot of people here, and I can't wait to get my EAD! But just trying to stay patient and hoping that everything goes smoothly. All in due time :)

For the first one regarding taxes, if you submitted a complete "filing copy" of the tax return then it should have been ok - double check that it was a filing copy. I would recommend to send in an official IRS transcript instead though. You can order it online thru the Get Transcript option, call in to have it mailed or make an appt at a taxpayer assistance center to have the print it out for you.

As to the I-864 not meeting poverty guidelines, sounds like you probably have two options. Resubmit everything from her current job including updated letter, current paystubs as far back as 6 mos. and attach a statement explaining why prior year income was low due to school and now has a stable job, etc. Either that or get a joint sponsor.

The third one is weird. I noticed the K-2 name does not appear on the I-797 for the I-129F so, in my case, I submitted as much as possible to show the K-2s are linked to the K-1 - I submitted the NVC letter which does show all their names and also our embassy in Mexico sends an "invite" letter when they schedule your K-1 interview and I sent that as well.

So Friday - nothing in the mailbox. On Tuesday it's gonna be 30 days without receiving hardcopies of the NOAs and biometric appointment. Great. They have the correct address. Seems like they just refuse working on my case

Wow, that was FAST! Congrats. I still am weighing my mind about getting the AP. I know I can try to send it in now to get the combo card or even after.

I'm just nervous about the part on the USCIS site that says admittance into the country is based on the officer. It's like bait and switch.

Also, can EAD be used to get a driver's license?

Thanks! They are processing my papers really fast, can't complain lol! Also they will schedule my interview I just don't know when. Hopefully soon lol.

Yes, EAD is enough for them to issue you a DL. In NY state they let you,I already have my DL thru my DACA.

You were in a similar situation as I was. I got the RFIE back and I had sent all the forms, bank statements, everything. I think I read somewhere before that they mostly care about income in the tax returns which sucks for students. I ended up choosing to use a co-sponsor anyway because my income barely surpasses poverty guidelines. But I'm even worried about my co-sponsor because he was a student last year, too. However he makes way more than I do. So we will see what happens.
