AOS September 2016 Filers

This has been my 90 days after filing i-485, I-131 and I-765 and ther is still no update on my EAD and AP.

I know iv got RFE and that may delay the EAD and AP tho. However, its been 20 days after submitting my RFE and they said they received it.

First, told me they sent me RFE on the status but i made an infopass and the officer said they didnt send it. that delayed me 3 weeks until i got RFE finally.

And i couldnt wait any longer, so i called to make a service request on tuesday by avoiding mentioning about RFE and just informed the Tier 1 officer that my EAD hasnt been updated for 87 days. The officer made a service request for me and told me to wait for the response for 14-30 days.

And i have the feeling that i will not hear from them until the 30th day cuz this happened to me with the first 2 service requests.

This is so frustrating that they work on the cases so slowly and its a holiday season now which will be even more slower.

Is there anyone with a problem like me?

I have to keep reading similar cases and hope to get any update from them soon.

Arrived USCIS Lockbocks........09-16-2016

NOA Form I 797C for all received ....09-25-2016

Biometrics Apt.......10-18-2016 ( Done within 10 minutes)

RFIE notice sent.......10-19-2016

SR for RFIE not received ...11-10-2016 ( Almost a month)

Called USCIS back after 10 days but they told me to chill since i already placed SR..

RFEI received 11-28-2016 (Guess what i found out, The first one sent my APT # was omitted ...LOL) I guess some of them re paid to PLAY around the office.

RFEI received by USCIS 12-1-2016 ( 1485 changed to Response to RFEI received )

EAD approved ...12-12-2016

EAD card mailed ...12-15-2016...Day 89

Note : RFEI is an AUTO pause not restart on both your I 765 and I 485 not RESTART , but when you call them

they tell you you have to wait for another 90 days but with what the Tier 2 officer told me you re told 90 days to make people

relax and stop them from calling every week ...LOL but in the real sense you get your EAD approve about two weeks from when they receive your RFIE .

Trust me the waiting game seems to be the toughest game i have played within 90 days but trust me your GOOD NEWS is about hit your mail in about 2 weeks .

Glad for you, but i think it is more the luck of the draw...they received my RFIE on 3rd Nov and still no EAD or AP. :-( Soon I hope though.

Was this conversation with the first initial (tier 1) rep or did you ask for a supervisor?

I asked for a Supervisor in my case, granted I had to politely insist a bit after I made the first rep trip himself up on his own words. It's all about language, how to approach and knowing what you can and cannot get accomplished.

For ex, the first rep said the system was down. I asked, the whole entire system is down? He then said, my system is down. I said ok can I speak to someone else who can help? He said I'd have to hang up and call back in. Which I then said so you cannot transfer me at all? He said no, to call back. At this point I asked for a supervisor and he then kind of stumbled and said his supervisor is at lunch, I then said is there any other supervisor around. He said nobody was available, then I swear two seconds later he said oh wait someone is available, let me transfer you. Clearly he was just trying to deter me lol

I hope this gives you an idea... just use your words wisely and be a little persistent (but polite)

Thank you for the advice, I think we are going to wait the 90 days since we are so close and that way we have more of an argument. We are 3 days out, so Monday I will call and see where we stand.

That's true too, you're not that far away from the 90 day mark. Good luck on Monday and let us know how it goes

I had a driver's licence because of my student visa. But when I wanted to change my name and extend the validity of the driver's licencse DMV told me that they cant verify my legal status here. Which is crazy since I have never been illegal here. I guess USCIS and DMV did not communicate well. Now I have to prove DMV my status here which I guess I can only after the approval

But what is very silly is that I did the written test 2 days before and got verified on the spot. Then I go for the driving test and pass that too and then they can't verify me!!! I'm like cooooooome on really it was fine 2 days ago!

that means everything is good. It's if it says Case is under review that it takes time like mine does. We want it to be returned

About health insurance it really shouldn't be a problem for them to take you as you are. We got on my husbands insurance before we even filed for AOS.

It is related with healthcare.gov/Obamacare enrollment. I did it for my wife 2 days ago, and it shows the same.

No worries, you can and are allowed to enroll based on your status as an Adjustment Applicant. The rep who helped you probably just gave you the easy way out for him/her. Here's the link with backup info: http://www.coveredca.com/individuals-and-families/getting-covered/immigrants/

- Employment Authorization and Advance Parole Card (I-512) (authorization for parole, indicating applicant for adjustment of status)

- Receipt showing filing or pending status of Form I-485 “Application to Register Permanent Residence or Adjust Status”
