Hi guys! Back to this place as I can send my packet off next week to withdraw my conditions, yay! Just wanted to sense-check what i am including and to see if I've missed anything:

* Competed form & check

* Photocopy of front and back of my current greencard

* Copy of the title on the car me and my hubby bought together in USA

* Copy of lease of old apartment and current apartment (where we have lived since I moved to the USA)

* Copy of our joint bank account info

* Copy of Paypal transfers to eachother

* Copy of me adding hubby to life insurance and healthcare plans with my work, and adding him as beneficiary to my 401k

Does that seem too thin?

I haven't included affidavits form friends and families, or copies of photos, but could if people recommend that?

You can also add Living Wills for each other; download the forms for your state, fill 'em out and get them notarized at your county court clerk's office.

Also, if you've had holiday cards mailed to you both, with both of your names on the envelope, that's good as well.

1. Evidence of Joint Ownership of Assets and Shared Financial Responsibility


  • Joint Federal / State Tax transcripts
  • Joint bank account statements
  • Proof of joint credit card use
  • Mortgage loan contract or lease contract with both partners’ names in it
  • Power of Attorney
  • Wills
  • Utility / Cable TV / Cell phone / Pets visit / Membership / Joint purchase bills
  • Life insurance policy showing spouse as beneficiary
  • Health insurance / Dental / Medical Bills
  • Car insurance
  • 401(K) account information showing spouse as beneficiary

2. Photographic Evidence


  • Photos of you two together
  • Photos of you two with family (such as wedding, parties, kids’ graduation, etc.)
  • Photos of you two in various locations and times

3. Other Evidence in Support of Bona Fide Marriage


  • Birth certificates of any children born to you together
  • Sworn affidavits of friends and/or family
  • Letters/cards from friends and/or family
  • Vacation / honeymoon photos / Boarding Passes showing both of you travelling together

Dumb question here, but is a tax transcript the same as a copy of my tax return? We filed as married but filed separately due to our jobs, but his name is on my tax return and I can print a copy off of Turbo tax...

Federal Tax Return - all forms submitted to IRS by the taxpayer for that tax year
Tax Transcript - an abbreviated version of tax data gleaned from all tax forms submitted to IRS. Generated by IRS, requested by TaxPayer from IRS.

So if you choose to print off from turbo tax, make you submit all the complete forms.

Tax transcript is easier in my opinion...less paperwork! Filed married but separate is fine as long as it was filed married. Good Luck.

Tax transcripts you can get from the IRS website. Nice thing about them is they're a lot shorter than sending the return.

Don't bother with affidavits, photos or holiday cards. They're only for folks who have no decent hard evidence. They want to see the hard evidence, and you've got that (your list in the first post is roughly exactly what I sent). People get RFEs when they don't send enough of their joint bank accounts, though, so make sure to send statements that cover the entire length of the account, so that they can see it was used - like, one for every month / quarter for the last 2 years.

This is what we sent in my RoC package (handily, I still have the quick contents page I typed up to put in front of the evidence):

  • Copy of Permanent Resident Card
  • 2013 married-filing-jointly tax transcript
  • 2014 married-filing-jointly form 4868 for tax filing extension
  • Joint bank account statements, 2015-04 - 2013-08
  • Deed for co-owned place of residence (#address, San Francisco)
  • Home insurance information
  • 401k, life-insurance and health benefit information

* I-130/CR-1 visa by Direct Consular Filing in London
3rd May 2013 - Married in London

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)

· Copy of W2 from 2015

· Copies of monthly bank statements from joint savings and checking accounts

· Copy of letter from Bank of America stating that we are both authorized users and card holders on my father’s credit card account

· Reference letter from Bank of America stating that we share joint checking and savings

· Voided check from joint bank account

· Copies of our VISA credit cards showing same credit card number

· Copy of 401K and life insurance plans from husbands place of work listing me as beneficiary

· Copy of joint health insurance, dental, cancer, accident, 401K and life insurance plans from my place of work

· Letter from my place of work stating that my husband is enrolled in my insurance as well as the beneficiary for life insurance and 401K

· Copy of joint health insurance cards and dental insurance cards

· Copies of Commerce car insurance bills for last 2 years showing both our names listed as operators

· Copy of Verizon cell phone bills spanning duration of residence in the US (family plan)

· Copy of our airline reservations from vacations together, including:

  • My trip to France to visit my husband in Oct 2013 while he waited for his green card
  • Trip to Texas with my husband and my parents in March 2016
  • Trip to France that my husband and I took to visit his parents in April 2016
  • Trip to California with my husband, his parents, and my parents in August
  • Copies of email and photos from our stay at Notchland inn, NH from inn owner (celebrated our 3 year anniversary)

· Photos spanning the entirety of marriage with friends/family & description

· Copies of wedding invitations envelopes from friends and envelope from IRS addressed to both of us

· Copy of Facebook messages sent from 01/2013-present to eachother

· 2 Notarized affidavits from my brother and our friend attesting to our relationship

· Copy of French lease + translation + translators certificate from when we were living in France

· Copy of my French visa in my passport showing that I was living at our address in Dijon

· Copy of my French credit card with husband's last name

Since yesterday I have gone through all my documents and have added more, so my packet is looking like this:

Bank statements from joint account, one a quarter from since we opened it (1.5 years)

Copies of my husband being my beneficiary to my pension/401k both in England and here in USA (so, since 2013)

Copies of utility bills from when we lived together in the UK with both names on (since 2012)

Copy of the title and credit document to our new car, with both names on

Copies of leases to both apartments we've lived in in the USA, both names on

Photos from trips/events since 2007

A few birthday, christmas, and anniversary cards

Copy of health coverage statements with both our names on

Change of address forms, showing we both moved to the same address

Colorado ownership car receipt with both names on

Voided check from joint bank account

Copy of Paypal transfers to eachother since 2012

Now from reading this, I'll also add in a copy of my husbands W2 from 2014, and both our tax transcripts from 2015.

Is that looking a little fuller now?

I think what you listed is fine. I think people tend to over-egg RoC. Worst case, they RFE for something, but so few people don't make it through this stage.
