we are submitting the aos and we already sealed the envelop. when i reviewed the sample cover letter from here, they have pay stubs? i didnt put my husbands pay stubs instead, just ITR and W2's. will that be fine?

Pay stubs are not required, but some people in the past have got RFEs for not including them (despite the fact they are supposedly optional these days). I think incidences of this happening are going down, and were mainly clustered soon after USCIS changed from requiring pay stubs to them being optional. I guess some employees didn't get the memo.

The instructions with form I-864 state 1-3 years tax returns are required, others with borderline income may include other things like recent pay stubs, and/or letter from employer, they are optional, if income on the tax returns is good then don't worry about the pay stubs.

I received an RFE and they wanted pay stubs from my cosponsor for the past 6 months. They didnt ask for mine though. (Probably cause my cosponsor is the one with all the money really.) :)

2/23/07 - Mailed AOS packet to Chicago

2/25/07 - Package arrived in Chicago

3/05/07 - Checks cashed

3/05/07 - Received NOAs for I-765, I-485, & I-130!

3/09/07 - All touched

3/10/07 - Received biometrics appt letter

3/12/07 - All touched

3/13/07 - I-130 & I-765 touched

3/15/07 - I-485 touched

3/15/07 - Received email informing me that an RFE has been mailed to me about the I-485

3/19/07 - Received RFE for I-485 in the mail.

3/20/07 - Biometrics appt

3/21/07 - I-485 & I-765 touched

3/23/07 - Mailed back RFE with signature confirmation

3/26/07 - RFE was delivered to Lee's Summit, MO & was signed for by "Ashley Love"

3/27/07 - Received email saying that RFE has been received at MSC and that case processing has resumed

3/27/07 - I-485 touched

3/28/07 - I-485 touched

4/17/07 - I-765 & I-130 touched

4/18/07 - All touched

8/02/07 - Received Permanent Resident Card!!!! No more USCIS until 2009!!!!!

We got an RFE for my daughter and they asked for pay stubs from my husband ( sponsor ) for the last 6 months .. and an employment letter ect ect ect ....... and his IRS transcipt / copy of his taxes we sent the first time showed he makes WELL over the amount needed .. So who knows what the ryme or reason to any of it is .. I think it's just random paper pushing Cr*p ! All we can do is give them what they are asking for ..

My cosponsor was well over the line with income as was proved on tax returns but we still got asked to send in auxillary information like paystubs, etc. RFE's for the I-864 are pretty common, so just have everything you could possibly send them (as outlined by the instructions on the form) prepared in case of an RFE. People don't need to freak out about RFE's so much, it's a pretty simple deal to reply to them (in most cases), and they don't seem to delay things really at all (it's the namechecks that delay stuff and nothing can be done about those).

Sorry YuAndDan, but saying "1-3 years tax returns are required" is confusing English, which is why I restated it. It was not a personal attack on you, I was simply making it clear.

what if the cosponsor doesn't have 6 mos of paystubs? i dunno if we'll get an rfe for it butttt ... hmm she has direct deposit so its possible past bank statements could do
