It's been 2 weeks since my wife and I had our i-485 case interview at our local USCIS office. The interview seemed to go well and the officer reviewing our case said to expect our cards in the mail within 7-10 days.
A couple days later my wife received a letter stating "Notice of File Transfer for Visa Regressed Cases".... Final decision cannot be made at this time... visa number not currently available.... transferring to the location listed.... etc.

We have made assumptions as to what it means but still aren't really sure why this occurred and if it's something to be concerned about. We have tried to search online but there apparently isn't much details on this issue.

The strangest thing is that I haven't received any documentation at all. I usually received a letter similar to hers at the same time but this time nothing came for me. No instructions as to what I should do or what the status of my case is at this point in time.

Last Thursday I finally decided to go online and check the status of my case using my receipt number, the number circled by the officer to check the status on each of our cases, but it doesn't work. My wife's number however works giving her details similar to the letter she received.

I get this error:

Validation Error(s)

You must correct the following error(s) before proceeding:

  • User-Defined Error

Was my case rejected? Did someone lose my documentation? Did someone input the wrong information and I was considered a no show for my interview?

I am sort of really stressed out by this right now and very confused as to why I cannot see an update on my case

Also what exactly does the "Notice of File Transfer for Visa Regressed Cases" on my wife's case means.

Does anyone have any information on these problems we're having.

Is it wise to get legal assistance at this time or just be patient?

We really appreciate any assistance and thank you so very much in advance.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hi Alex, We recently had an interview for my parents, and they mentioned during the interview that the bio metrics were not done correctly by the person doing the fingerprinting and that they "were waiting" for them.He said we may need to re-do the fingerprints and that this could take up to a month to get a notice. We got a message that basically said "my case needs to be reviewed." I would be on the look out for a new bio metrics notice.

I am just guessing on what this could be for you, but the IO usually wont say" your approved" unless its a done deal. Its probably just a technical glitch like fingerprinting. I would call the uscis number and ask to speak to a tier 2 rep, they should be able to tell you exactly what happened. if that doesn't work make an info pass appointment.

Thank you guys for your responses.

My wife is an H1B holder and I am H4; well we were. We now have our EAD cards until next year and her company work contract has been renewed.
It's been 1 year calendar since we filed our paperwork and our attorney who we hired to help us with our paperwork, screwed up my paperwork, told me the wrong category for my EAD and it was sent back to me. Then she dishonestly tried to cover herself by lying and saying I didn't qualify. Luckily I called USCIS and the super helpful agent gave me much better information to correct and resubmit and got approved 3 months later. Anyhow, that's how I was lead here since I don't trust paying an immigration attorney again until I know better.

We had our Biometric last year, about 1 month after we filed. Yes there was an issue with my wife's prints but I think that eventually got remedied earlier this year when she got had to send in a background check and was printed at the local police dept.

Thanks for the info Harry, I called USCIS and after a bit of bouncing I finally got connected to the Tier 2 agent. The agent was actually really informative and considerate, he informed me that my paperwork is still being processed, just hang in there a bit longer. As for my Online status, the webpage is actually managed by a 3rd party and not directly by USCIS agents and even though he would like to update my info there, he's not able to. I shouldn't rely too much on the online system and even though it's inconvenience to call, just do so and connect to an agent if I need help or have question.

He also said that my wife's Notice of File Transfer for Visa Regressed Cases" letter on the other hand applies to the 2011 bulletin when visa numbers are no longer available for that fiscal year. So now that that was explained to me, I did a bit of research and found this link most helpful;
http://www.seguritan.com/print.php?print=1&ContentID=23249
What I don't understand is will our application be processed as soon as numbers become available and how long can this take, months, years, decades? I'm really curious since there is no place that mentions a time frame.
Has anyone ever experienced this? I know each case is unique but how long did it take? I'm just wondering the time for best case vs worst case scenario.

Thanks guys
