Hi eveybody! I have a couple question.

A week ago we received a RFIE because we didn't file an i-864 for my spouse since her income is not enough and we thought that it wasn't required when having a sponsor which income is more than enough (her mother).

By completing another i-864 we noticed that her mother, in part 1, marked herself as the petitioner filing for her immigrant relative. Which is wrong since she is the first and only joint sponsor. What should we do at this point? Explain the mistake on a cover page, or explain the mistake on a cover page and add a correct copy of her mother's i-864 or just ignore the mistake?

The second question is about part 5, the sponsor's household size. I and my wife live with her dad, but shouldn't the household size just come up to two: me and her? Because by checking part 1. (Provide the number you entered in part [...], 2. (Yourself) and 3. (If you are currently married, enter "1" for your spouse the household size comes up to three.

The sponsor, your spouse has to do the I-864 even if 0 income. The co-sponsor should fill out a corrected form. Cover all your bases. Never ignore anything.. they don't..lol. As for your second question, do your wife's parents still claim her on their taxes? If so, its considered the same household.Household size would be parent(s)& your spouse & you. If your wife files her own taxes and only claims herself, then the household size for part 5 would be 2. If she claims herself and a dependent, then part 5 would be 3. (you, her, and the dependent). Hope this helps.

You should send in the I-864 and required supporting documents from the USC petitioner/sponsor, plus send a corrected I-864 for the joint sponsor.

The household size is 2. You are the intending immigrant being counted in #1. It states not to count anyone twice, and all others being counted below #1 are persons not being sponsored on the affidavit. You are being sponsored, and are the immigrant counted in #1. You would not be counted again in #3.
