Just put 'N/A' where it asks for the income from previous years and have her write a letter explaining that she worked part time jobs and didn't earn the minimum income in previous years to file a tax return. I'm assuming you're aware you will need a joint sponsor.

It varies between tax years and depends on how many people are in the household.

Sorry to sound negative here but shouldn't she have found out the minimum threshold level before deciding her past income was too little?

She can attach an explanation as she was not required to file taxes and as you stated, she cannot record her income as $0.

Hello VJ members kindly answer me following questions, its very urgent and I am worried:

- My wife is USA passport holder & her income of previous years is
2015 5000 US $ after tax return
2014 400 US $ after tax return
2013 0 US $ after tax return
She was not in USA in 2013 that's why her income is zero. Now question is that she had taken food stamps in year 2014 and 2015 with her Job as she has two years daughter from her ex Pakistani husband who died in Pakistan in 2013 and he didn't come to USA. We have joint sponsor wife's uncle in our case. Is it fine or is it acceptable by NVC as my wife did job, only made 5000 US $ in 2015 & had taken food stamps but we have joint sponsor who has income much above than poverty guidelines. Does NVC will approve our documents with Joint sponsor? Also is to good to tell NVC on separate sheet that she had taken food stamps in 2014 & 2015.
-My wife is currently in Pakistan since our marriage as we got married in January 2016. What she has to write in her current income zero "0". Also is to good to tell NVC on separate sheet that she is in Pakistan that's why her income is Zero.
-Can we send all documents to NVC via DHL or FEDEX from Pakistan including joint sponsor's affidavit of support? My wife is my agent in DS-261 but she is in Pakistan. Or we have to send documents to my wife's home in USA then her sister send these documents to NVC? Can my sister in law submit/post these documents with her name to NVC with her name or she should post these documents to NVC with my wife's name?
-My wife filed her 2015 & 2014 tax returns as single not as a widow because her ex husband was died in Pakistan in 2013 after 1 year of marriage and he didn't come to USA so she filed single as he has no status in USA, is it fine or is it acceptable?
-My wife didn't include her daughter in 2015 & 2014 tax returns because her daughter is dependent on her grand father's tax returns in USA since 2014. Does my wife has to include her daughter in sponsor's house hold size in form I-864 or not as her daughter is in her grandfather's tax returns since 2014.

The forpose of Affidavit of support is for petitioner to demonstrate that the appplicant will not go into welfare. Sponsors are good to prove you will not go into welfare. No need for wife to report she received food stamps. However, I believe your wife has to have stablished residency in the US. This link will help with this question:

I found this good thread here in VJ
this is from that thread regarding an unemployed petitioner:

For Part 6, you should select "Unemployed" and select the date when your petitioner last employed (even as a part-time/temp worker). Otherwise, hand-write "Never Worked" in the date box

For current income, enter "0.00

and also review:

The documents have to come with your wife's name and as long as you get a tracking number from parcel service I do not see a problem for them to be send off from Pakistan.
I could not find information about sending documents when US citizen is overseas, one member mentions about address when answering DS 260: "You'll want to use your current, foreign address as this is where they'll be sending you stuff" and you will also have to provide address were you intend to live in US. http://www.visajourney.com/forums/topic/576429-questions-about-ds-260-with-a-usc-petitioner-living-abroad/

Yes is fine.
To answer this question I read IRS definition of filing status. I believe she file correctly because her husband died in 2013 so she was a widow before January 1, 2014 (when she file as single). Here is the link to IRS: https://www.irs.gov/publications/p17/ch02.html
For 2013, if she had not income she will have to write "NOT REQUIRED TO FILE - NO INCOME" (you can see response here: http://www.visajourney.com/forums/topic/529237-affidavit-of-support-i-864-petitioner-no-income-student/)

Yes, she does count her daughter in I-864 form.

  • The child does not live with you
  • You do not have legal custody of the child
  • You do not pay any support for the child

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
