I did follow this thread you said you initially held it. You didnt report. Now that you are scorned you want to.

Do you realize this?

Also, unfortunatly its a risk we take bringing people over from another country who we prob spent very little time with in person.

Im not gonna hate on you for sneaking a peek in her phone but its NOT evidence. Its hear say.

Follow the thread please and move on your only gonna waste more of your time on someone who probrably cant remember your name.

Well that's why I'm here. I'm trying to figure out what's what. What would be considered "hard evidence?"

USCIS considers text messages as proof to show a bonafide relationship (it was one of the many things I included in our I-129F package). I figured they would also consider it as proof of fraudulent intentions.

So do you have text messages or what? You keep saying you have proof, you've seen things, etc. What EXACT hard evience do you have?

For example, I have proof of citizenship in my country via my birth certificte and passport which I can hand over to someone. I do not have proof by simply saying "I have proof" or "I peeked at my birth certificate once". I have actual documentation.

Now, what proof do you have?

I conversation between her and her best friend who BOTH were targeting me. Pages and pages of text saying as clear as day of her entering our relationship not for love but with the sole intention of using me to obtain a green card.

How were these 600 pages and six months of texts in pdf format obtained? And in what state do you reside?

@cheeszees - they were obtained in New York while we were there on vacation but I live in California. I plugged in her phone to my laptop one night she was sleeping. We were dating for six months then and already engaged and making steady progress through the 129-F process.

I only did what I did out of fear. I witness her "shady" behavior with her phone pretty much since the beginning of the relationship. Again not proud of it but I stand by that decision because it saved me from potential disaster.

@anitafeliz and the rest of the peanut gallery - look I understand that on topics like these it's easy to get personal "just move on" can be applicable to everything but I'm looking for technical answers here. I'm just looking for information not judgement so please if you don't have anything technical to contribute please don't.

The technical answers I'm looking for are simple;

(1) Is what I have considered good evidence? Good in the sense that USCIS will take it seriously.

(2) Can I even legally submit what I have as evidence?

(3) Legalities aside, what happens if I do submit the letter and evidence?

(4) Are there any future ramifications if I leave this case as is and reapply for another K1 or K3 visa later (i.e. will i be questioned about my past failed I-129F)?

Also are there any future ramifications if I end up reporting the fraud with the evidence (i.e. will this have any effect on any future petition attempts)?

Again need help with answers to these questions, technical answers only please

(4) Are there any future ramifications if I leave this case as is and reapply for another K1 or K3 visa later (i.e. will i be questioned about my past failed I-129F)?NO i submited a second K1 a year later first one like u tried to use me to get here i have a child with him and he lives an hour away happily ever after. Doesnt remember his daugther. No one even asked on my interview with new fiancee about old fiancee. I just submitted a waiver when i got the rfe to submit at uscis stage

Just go ahead and do whatever you want to do. Submit it to USCIS/the black hole and get it off your chest.

Bottom line is, you're never going to find out for sure what USCIS decides to do with it. In order to have an inkling, you'd have to find a way to spy on your ex, which I do not recommend.

No one at USCIS is going to waste their time reading through 600 pages of texts in a pdf that you could have typed up yourself. It isn't "hard evidence", and the legality of how you obtained it in the first place is questionable.

Your obsession with this is unfair to your current girlfriend.

@anitafeliz - so what happens if your ex (the one that tried to use you) finds someone else to petition him after the already failed 129F/K1 visa with you?

@B&Z - why would I submit the entire text log?? I would only submit the pages that are directly relevant to the sham marriage which comes out to about a dozen or so.

Hypothetical situation...

I go ahead and submit the relevant pages showing her intent to enter our relationship strictly for the purposes of evading immigration laws (legalities aside).

She later reapplies for another K1/K3 or any other kind of visa for that matter and during her interview for that new visa the officer asks her about her previously failed 129F which the petitioner (me) cancelled due to fraud and questions her about the evidence which he/she has right there during the interview?

The officer simply has to ask "are these your text messages?" She can't lie and say "no" and by admitting there that those are indeed her text messages the interviewing officer/USCIS knows the truth about her; boom case closed!

I know this sounds naive and please keep in mind that of course I've never been in this situation before but wouldn't the whistle blowing process be that easy in these cases?

My ex went all they way to the interview was put in AP PENDING DNA ANALYSIS while in AP his family based visa through dad became available to he told me to shove mine.....

Long story short i filed another petition all i needed was an imbra waiver.

Stop obsessing with her and worry about who you have now dont let ex ruin you current relationship.

My ex had another child and had lied to me about everything im so happy now hes out of my life i never obsessed he lives an hour away i have never looked that way hes not worth my time!!

Your evidence (I'll say it again, and it being less than 600 pages still isn't going to help you - 12 or so pages that you could have typed up yourself) has to be SO COMPELLING that it makes USCIS create a CLASS hit for it, so that it will pop up in the State Department's system when they're going through any future visa application that your ex might submit.

What you're planning on sending to USCIS is akin to a "poison pen" letter and it holds virtually no weight, especially since your allegations are not national security or terrorism-related.

Any scrutiny she may get in a future fiance/spouse petition will be related to her previous cancelled I-129f petition. You'd be LUCKY if USCIS created a CLASS hit for your ex based on your allegation of fraud. The only fraud they really take seriously is identity fraud. If your ex gets petitioned by someone else, it will be up to them to come up with enough evidence to show that their relationship is bona fide. Just because her relationship with you was a total scam doesn't mean she can't ever be in a bona fide relationship with an American ever in her life.

She may have some trouble getting a new/renewed B visa in the future due to the previous I-129f based on 214b (immigrant intent), but who knows.

Like I said...just SEND YOUR LETTER/"EVIDENCE" TO THEM, and then let it go because you're not going to be able to find out whether anyone in the government cares about it enough to stop her in the future or not, unless you stalk your ex online and catch her complaining about difficulties with a future visa application or petition.

Send your stuff already, pat yourself on the back for trying your best, and concentrate on your current girlfriend.
