Well i decided to go to my local office to check why was taking so long and i was told that they just got my background check yesterday so if they are done in batches maybe more of us will be getting approved no longer than next week, PD august 15..😎😎😎

How exactly did you make an appointment with your local office? Just curious...thanks!

Thanks. Quick question: how strict are they about going to your SPECIFIC local office. The one it recommends for me seemingly has no appointments currently; but there's another local office that's a bit further away that does have appointments. Will they not talk to you or see you if you go to a different office?

They will see you, just select the office you want the appointment and the date.

Does anyone know once I-130 visa is approved can you still go to America under VWP and visit family for a few weeks whilst waiting for NVC? Also has anyone got a timeframe for how long the NVC takes to process once I-130 is approved. my wife and daughter left Australia last week and I am desperate to get over there also once this visa is approved.

The current processing time at nvc is 11 weeks.

08/15/2016: I-130 sent to USCIS
08/18/2016: NOA1, I-130 received at USCIS Nebraska Service Center
02/17/2017: NOA2, I-130 approved 

02/24/2017: Notification received on App (I130 Approved)
02/26/2017: Approved I-130 sent to NVC

02/28/2017: (NOA2) Notification received via snail mail.

03/11/2017: Received email with case number and invoice number
03/11/2017: DS 261 Completed

03/11/2017: AOS fees paid

You can try and visit under the visa waiver program, but there is no guarantee you will be allowed into the country. The customs and immigration officer has ultimate say on who is allowed into the country. One of the biggest reasons people are denied entry is if they are unable to sufficiently prove they have strong ties to their country of origin and intend to return. The problem many people who apply for the CR1 visa is that you've basically told the US government that you want to move to the US (that's the whole point of this visa!!), and as such people have been turned away at the port of entry. So basically, if you can prove strong ties to Australia and clearly demonstrate you intend to return you can try and visit. NOTE: If you do attempt this be SURE to be 1000% honest with the customs officer; if asked tell them clearly you're married to a US citizen and are currently applying for a CR1 visa. Getting denied entry into the country won't affect your CR1 visa UNLESS you lie to the customs officer in any way.

 

The current time-frame for the NVC process is as follows --

  • Application gets sent to NVC : 1 -2 weeks.
  • DS 260 and IV/AOS fees are unlocked on the website: 1-2 weeks.
  • NVC reviews your IV and AOS applications : 10-12 weeks.
  • If any mistakes are found and you receive a checklist: additional 10 weeks per checklist.
  • Scheduling interview: depends on your embassy; examine your country specific sub-forum for more detailed time estimates.

On average you're looking at around 3 months to get through the NVC.
