I randomly picked 250 I-130 petitions with PD in early August of 2016 and some with an even earlier PD (around mid to late July, 2016) and found that about 195 cases (78%) have been adjudicated (either approved or RFE) from February 1, 2017 to present and the rest are still in "case was received" status (about 17%).... and mine is one of them.... sigh. 

Yep..I know..I had this app on my phone which could run 500 application numbers at one go and I know that quite a few applications from Aug 9 are still left..

 

I uninstalled the app because it was driving me crazy..but it would be interesting to see what the next official update is regarding processing timelines..

 

At least then there is a legitimate reason to raise an inquiry, schedule an appointment etc.

Was it a long reference number with some letters? I believe they will assign your request to an officer for response, similar to "submit a case inquiry".

The background check level you get depends on the application data or, specifically, nationality, you will be assigned one or more categories or class. These are code named: 

Bear (for foreign government officials, representatives to international organisations,and their families)

Donkey (name hits, certain nationalities)

Merlin (for refugees and asylum seekers)

Eagle(certain nationals of Cuba, China, Russia, Iran, Vietnam)

It seems kinda strange that on the FBI website, they only indicate that USCIS submits name check requests on individuals applying for asylum, adjustment of status to legal permanent resident, naturalization, and waivers (https://www.fbi.gov/services/records-management/name-checks).

 

I just hope that if they were to take forever to conduct the background check at the I-130 stage, they can speed up in the NVC stage. And it just seems that when officers answer you that your case in under background check, there is absolutely nothing you can do---no timeline, no information, no nothing.

The checks are far more than we are allowed to know, the page states "There are over 265 different FBI locations that could house information pertinent to a name check request." and if you have a name similar to a known person who lived nearby or studied in the same year at college, more checks will be made.

 

You only have to look at the Congressional hearings to see what little is really known about the security services and the culture of "we can tell you when we think you need or are allowed to know." - 90% of which is pure BS by wannabe "ghosts and geeks" not close enough to the reality and truth, puffed up by their own importance clutching at the coat tails of those who really are "in the know." Sad but true.

 

You are correct, there is nothing you can do, however I would still try to get on the case of a Tier 2 person OR say F*** it as I did and do something else well away from USCIS and the rest.

Your approvals are just around the corner August filers, just hang in there! They started on August in late January; I would think 2 months should be plenty of time even for Nebraska to all of the August petitions.

CR-1 Visa Timeline

7/27/2016: I-130 mailed.

8/02/2016: NOA1.

2/17/2017: NOA2.

2/24/2017: I-130 sent to NVC.

 

NVC

3/03/2017:  I-130 received.

3/09/2017: Case # and invoice # received, AOS and IV fees paid.

3/16/2017: DS-260 submitted; AOS and IV packets sent with EP.

4/06/2017: Case complete.

 

Consulate

4/15/2017: Interview email (P4).

5/09/2017: Medical.

5/15/2017: Interview.

5/19/2017: Visa in hand.

its the same way talk to those agents and ask them that u want to speak to a tier 2 officer....and they take ur LIN number down and say they wll call u back... they will give u a estimate...for me it was 260 minutes....
