I called USCIS and received a response of "your petition is pending background check and FBI is the agent that does it".... is it a general response from them usually? Mine is just a standalone I-130 petition, so I thought they only check the legality and the bona fide of the marriage...

The background check level you get depends on the application data or, specifically, nationality, you will be assigned one or more categories or class. These are code named: 

Bear (for foreign government officials, representatives to international organisations,and their families)

Donkey (name hits, certain nationalities)

Merlin (for refugees and asylum seekers)

Eagle(certain nationals of Cuba, China, Russia, Iran, Vietnam)

If you ask for a call back expect them to call and YOU have to be there to answer, if not, they log it as called but no reply, the person may try again but more likely just log it is called again but not there ...... it happens. For you, you get blocked for a month expediting and getting Tier 2 because of "the rules".

Thank God our case got Approved, I just received the email and confirm on the USCIS website.  My PD was August 30th.

My prayers goes to everyone who's still waiting for that approval, don't lose faith.

What's next after this?

3/16/2017: DS-260 submitted; AOS and IV packets sent with EP.

4/06/2017: Case complete.

 

Consulate

4/15/2017: Interview email (P4).

5/09/2017: Medical.

5/15/2017: Interview.

5/19/2017: Visa in hand.

So... I randomly picked 250 I-130 petitions with PD in early August of 2016 and some with an even earlier PD (around mid to late July, 2016) and found that about 195 cases (78%) have been adjudicated (either approved or RFE) from February 1, 2017 to present and the rest are still in "case was received" status (about 17%).... and mine is one of them.... sigh.

Hey...quick question..what did you ask to be transferred to a Tier 2 officer.

 

We called and asked but were given a reference number saying they will call us back. Did you guys face the same thing ?

 

Anyone else who called a Tier 2 officer face the same thing?
