Hi,

My wife just got an RFE for her I-751 application.

Her fingerprints were rejected twice as unreadable...not sure why we paid the Biometric fee for.

Anyway, now, we were asked to provide police clearance certificate.

How one obtain a police certificate here is US, specifically in TX?

Is it possible to obtain it via online instead or do we have to go to local police office?

It is my impression that obtaining police clearance certificates in the US for USCIS purposes is not necessary. Such activities are conducted by other US Federal agencies, i.e., FBI.

If you are referring to obtaining specific criminal history records as described in the I-751 instructions:

Criminal History

If you have ever been arrested or detained by any law enforcement of cer for any reason, either in the United States or abroad, and no charges were led, submit an original of cial statement by the arresting agency or applicable court order con rming that no charges were led.

If you have ever been arrested or detained by any law enforcement of cer for any reason, either in the United States or abroad, and charges were led, or if charges were led against you without an arrest, submit an original or court-certi ed copy of the complete arrest record and/or disposition for each incident (for example, dismissal order, conviction record, or acquittal order).

It seems to me that it is clear that we need to provide the letter from the local police department here in US as well since my wife has been staying in the US since she got her temporary US green card.

You're right, it sounds like you need to get a police clearance yourselves... Which sounds bizarre, but it is what it is. If I were you, I'd go to your local police department or phone them and ask what the procedure is. You might be able to find out the protocol online (do a google search) but you'll almost certainly have to go in person to get the check done.

Interesting that USCIS would require this on a I-751 RFE. :wacko:

Though, I have to say, looking at the hoops some folks, including ourselves, had to jump through during this phase of the immigration process....it makes me wonder about some of the training consistency of the adjudicators.
