My wife and I attending our AOS interview yesterday and I will say it went well. She asked a series of questions to both of us and we answered them correctly. My asked my wife for her birth certificate but she only had a birth card. So she stressed the need for my wife to get it. We submitted a joint bank account statement, car insurance document and a joint lease agreement. We are renting from my wife'should mother. The interviewer said she will review the submitted documents and if she needs additional information we will receive a letter in the mail. Is this going to be a problem? Is it legal for us to rent from her mother?

Wait to see if you hear about approval or request for documents. The matter is out of your hands now so sit back and relax.

And it is, indeed, legal to rent from your mother-in-law in the United States, as in many other countries. Some people, however, would argue that it is not a wise long-term strategy. :)

Good luck.

Did you supply a copy of your wife's birth certificate with the initial I-130 / I-485 filing? The adjudicator requested the original and you gave a "birth card"? Is that what happened? I don't think they care about from whom you are renting; the birth certificate seems to be the concern.

I wouldn't stress too much, especially about the lease. A lot of people live with family or friends and don't have a formal lease agreement. What it does do is require your other evidence to be a little stronger especially if none of your utilities are in both names.

If I were you, I'd start saving your joint bank statements and other documents that you'll need for ROC (check the guide). Then if they need more evidence you'll already have started your pile. But if they don't, then you already have it for the next process. Has your wife located her birth certificate yet? If not, I'd make that the highest priority. It can be replaced but it does take a few days.
