WIC and Medicaid for new born

Hi All,

AOS processor with USC wife here, we had a new born baby yesterday and this morning we had a social worker come around to tell us we were entitled to WIC and Medicaid for the baby.

The issue is I have a co-sponsor who makes $130,000 and the application mentions that I am not allowed to use any "means tested benefits". While obviously I'm not going to claim them myself, is my USC daughter entitled to them? I notice CHIP was explicitly mentioned on the barred benefits.

Regardless of the situation, we have a private, child only plan for the baby to enroll in. However if she's entitled to WIC and free healthcare im all for it, so long as the baby actually is entitled to it and it doesnt come back on my sponsor.

As we are married the benefit is calculated by family income.

Congratulations!!! You can get wic, Medicare and foodstamps for your daughter. You as the LPR can not receive anything your daughter still qualifies though.

With Dss(dept of social services) when a child is born they include the mother and father as a family even if they are not married I think your wife would just explain that she would only want benefits for her and your daughter and to exclude you

The baby is an American and may receive benefits.

You may not receive benefits, but if wife and child are USC then that is fine. Since you live in NY, there are some carved out exceptions to the very specific rules regarding what an immigrant can actually obtain compared to anywhere else in the US... but this should not be a concern for you anyway since you are not the one seeking such benefits.
