There is no ban until the person leaves USA.

Overstay is forgiven for immediate relatives of US Citizen if they adjust status inside US.

The USCIS expanded the provisional waiver for people who entered the U.S. on a K-1 fiancée visa but did not marry the US citizen(petitioner) and got married to a different person, It becomes effective today( Aug 29,2016) the expansion of the provisional waiver for this category.

Wait, what??? Is this real????

This just opens the doors for more fraud. Now a foriener can use a USC to foot the bill to get to the US with almost no restrictions.

Most likely for people to use K1 visa (otherwise impossible to get tourist visa) to try and see if we are compatible before marriage.

If not, the K1 gets to stay in US (illegally once the I-94 expires) and continue USC spouse shopping.
