... federal prosecutors in Texas generally have declined to bring criminal charges against illegal immigrants caught crossing the border — until at least their sixth arrest.

A heavily redacted Department of Justice memo from late 2005 disclosed the prosecution guidelines for immigration offenses, numbers the federal government tries to keep classified. DOJ officials would not say Thursday whether it has adjusted the number since the memo was written, citing "law enforcement reasons."

The prosecution guidelines have been a source of frustration for years among the ranks of U.S. Border Patrol agents, said T.J. Bonner, president of the National Border Patrol Council. Smugglers can figure out the criteria by trial and error, he said, and can exploit it to avoid prosecution.

"It's devastating on morale," Bonner said.

How do they keep track of the ones they have arrested? Do they ask for an ID? How do they know if they have arrested the same person more than once? I'm sure the aliens always cooperate with the border agents and given the correct name. In other words they don't prosecute anyone for these violations of OUR laws.

No...what is outrageous is that there is legislation right now in the US House (Gutierrez/Flake) and in the US Senate (Kennedy/McCain) to amnesty almost all these illegal aliens that have not only cheated their way into America illegally, but use fraud, ID theft, etc. to continue to work, live, thrive, and survive here illegally.

Both legislations give these cheaters, liars, and fraudsters permanent residency and a path to US citizenship. Just the kind of people we want as US citizens and permanent residents...people that have zero respect for our laws and zero respect for our country's sovereignty.

What kind of idiots are running this country? Write them a letter and let them know.

Thank you, peejay. Your post was the spark that I needed to voice my desires to my reps. All 3 contacted!

Not to rain on the outrage parade.... but according to the full article, it's not like they just let them go into the U.S. They're catching them at the border and deporting them rather than putting them into American jails, unless they're repeat offenders (i.e., deporting them doesn't take).

I'd rather have them deported than sitting in an American jail at taxpayer expense.

Not arrest, detention. ICE detains, it doesn't arrest. Not the same thing. What they do is take the fingerprints, compare them, and say "No, you can't come in" and shove 'em back across the border. It's not even a deportation, it's more like a denial of admission (just like if you landed at an airport without a visa, they'd hold you and put you back on a plane in the other direction).

In a words: Fingerprints. They have several fingerprint databases they use to keep track.

If you're willing to pay for fifty times the federal judges, fifty times the number of federal courthouses, fifty times the federal jails, fifty times the federal marshals, fifty times the number of court staff ... then the District of New Mexico would be happy to prosecute all 110,000 aliens who cross the border illegally [edit: that's just in NM, it doesn't count Texas, Arizona, California, or any of the other states] every year instead of the 2000 being prosecuted now.

But I bet you'd ###### about your taxes being too high if Congress tried.
