Hello - I entered US on a B1/B2 visa nearly 2 months ago and have a valid 1-94 until December 2016.

When I entered US my husband was on his Green Card and in process to obtain his citizenship.

My initial plan was to visit him and then go back until his citizenship comes thru and then apply for the CR1 from our home country. However - his application processed quickly and he got his citizenship recently.

Now that I am here and he has got his citizenship - we were wondering about the possibility of changing my status while I am still in US. so wanted to clarify a few questions:

1. Is it okay to apply for AOS staying in the US?

2. Should I wait for 60 days after his citizenship to apply? (something about the 30/60/90 day rule)

3. Drop the AOS idea and go back to my home country and apply for CR1 from there..

You are here legally, and a thing happened (quick naturalisation) that changed your plans, you have a very good case for AOS.

You can absolutely go home if you want and do the CR-1, say if you need time to wrap up your life there or want to work a bit longer at a job, but you do not have to.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
